Complaint againt former social welfare tenant

    how do i go about setting up a complaint against a former tenant ???

    my tenant just left the middle of Dec 2011 and was paying me rent by social welfare , she had 4 kids , no partner.

    she never paid a deposit as the social welfare don't pay deposits.

    she wrecked the house , pulled curtain poles down , i needed to get new suite of furniture , carpets in 3 bedrooms , 3 beds , chest of drawers , lino in kitchen , skip to empty my back garden and shed ( full of her crap ) and paint every wall and ceiling and skirting , i have registered with the PRTB , she was a settled traveller ( didn't know this when she moved in ) because she had'nt got a traveller accent and it was only when i received the first social cheque with her name did it click

    now there is an outstanding ESB bill for over €500 and she also forged a letter with my name to get a pre-pay gas meter , and bills for a diesel card in her sons dads name with €4800 owed on that and apparently he had a breakdown removal company which owes €2500 to the golden pages for advertising

    i want to go to the social to get payment off somebody for damage to my property is this possible ????

    could i bring all these bills to the social welfare to make them aware of what she is doing ???? so as they might suspend her payments or even stop them

    ive a 1 year old kid and she knows this and i did everything she asked of me as a landlord and i didnt need this time an expense to re-decorate , so i have no sympathy for her or her kids if thats how she acts

    Why did you post it's in the taxation thread, out of interest?

    You'd need to make a case with the PRTB. I don't think the Social Welfare will give you anything tbh. You could maybe go down the small Claims Court route either

    i posted it in state benefits don't know why is in here :confused:

    i know the social won't give anything for this , but i want them to stop her payments , and to know what she is doing

    i reckon she stays in a place for a while and and racks up huge bills and then moves on and does it again somewhere else , which isn't right

    Small Claims Court is for claims up to €1,500 only, if I'm not mistaken?

    That's a dreadful ordeal you've been put through Eircom_sucks. They won't stop her payments though, I could bet on it. Might be worth getting some legal advice, even though it's expensive.

    I'd suggest that your first port of call should be a criminal complaint for fraud via the Gardaí.

    id be worried as their travellers , hardly law abiding citizens ( most are , but these particular are not )

    worried the house be attacked or burned down

    I can understand that however by doing nothing, you're leaving countless other people open to the abuse, damage and ultimately costs that you've suffered.

    Talk to the Gardai. They're not going to put you in a situation whereby you're in danger and will give you the best (free) advice on how to proceed.

    Going to the social welfare will do nothing.

    We bought a house last year and moved into it in November. There was a stream of post coming to the house addressed to various members of a Traveller family that had lived here some time beforehand. We know that they haven't lived in the house since before August as that is when the house was put on the market.

    Anyhow, just before Christmas a letter came from the social welfare but because of the way the letter was in the envelope we couldn't see the name so we opened it, thinking it was for us. It was a PPS card for one of the previous tenants, so my husband took the card to the local social welfare office and explained the situation and told them that there is no one else living at our address.

    Fast forward to this week and another letter arrived addressed to the same person. We opened it and it was from the Social welfare about a new claim that was opened by the same person.

    The social welfare must have the worse database ever.

    It's a bad situation you are left with but, unfortunately, you have learned in a very hard way that you should have insisted on a deposit from your tenant. The threat of not having it returned is what puts pressure on any tenant to keep and leave the property in good order. You would also have the right and responsibility to inspect the property during the tenancy, after having given notice of that intention. The Community Welfare Officers will sometimes help a tenant with part of the deposit but always expect that they come up with the rest themselves.

    In order for the tenant to get Rent Supplement they would have to have produce to the CWO a form signed by you and that would have made it plain to you that they would be in receipt of Rent Supplement as well as give you their name etc. They would also have to have produced a lease, rent book or tenancy agreement. This lady would also have been expected to pay Euro 24 of her own money per week towards the rent.     At this point, your only redress would be pursue your ex-tenant through the Gardai and the courts. If you wanted to bring the matter to the attention of the CWO (they continue to work out of the HSE health centres although, since last October, they are employed by the Dept of Social Protection). Your ex-tenant may well have moved out of the area by now but you could ask for the CWO, if they can trace her, to pass the info onto the new CWO.

    If you are in a position to rent out your property for a certain amount of years, you should look into the RAS Scheme http://www.citizensinformation.ie/en/housing/local_authority_and_social_housing/rental_accommodation_scheme.html

    This might sound like a stupid idea, but what about insurance? Do you have the house insured? And if so, why cant you make a claim saying the house was vandalised by the tenant?

    Can I ask what the damage to your property has to do with social welfare? There are bad tenants everywhere. If you think that someone is committing welfare fraud, then by all means report them. There's actually a link to do so on their homepage.
