there is a ban but for folks that have permission;) it doesnt count. Something to do with a farmer tackling 2 boys lamping his field, the 2 boys battered the farmer. Then the farmers "sons" took it upon themselves to pass judgment on them, nearly had one young fello in a coma when they finished. Since that alot of farms have shut up shop now because of it. Sad to see:mad:

I have a few permissions between Drogheda and Dundalk and 2 of the farmers who I do a bit of work for and know very well and whose land I shoot , said they had been visited by guards in the past week and were questioned about who they let shoot on the land etc.. To cut a long story short they were asked to tell anyone lamping that they were not to until further notice. I cant say too much on here but its not looking good as there is talk of temporary restrictions and bans  might I add not only in this area, but all over the country as I believe its only now that these poachers are being taken seriously by the Guards. Wish I could say more lads but I don't want to get anyone or myself in trouble !!!

plenty of lads have been saying this about lamping and poaching , spoke to one lad recently in cork and he said its not a matter of if but when that someone will be killed in this country

Jesus that is funny. I was out the other night (in Dundalk) and a guard stopped me and I got into a row with him. Long story short it ended with "either go home or Im arresting you and taking the gun"... needless to say I didnt fancy those odds so I came home. I thought he was just on a power trip. I guess that explains it.

i was told the same today that the gaurds would sooner see it stop. would it be a complete ban or would someone need a special licence?

I don't think a special license would mean anything, if the cnuts are going to shoot as illegally as they're doing then nothing is really going to stop them or put them off until they are caught red handed and then publicly humiliated. We have incredibly strict licensing laws here and I cant see how its possible for such people to be granted licenses  it just doesn't make sense !!!

We got stopped by the guards one night not too far from just after leaving my house. he followed us down a little backroad but didnt stop us until we got out onto the main road.
He came up the the jeep and the first thing he said was identification please, never asked for a drivers licence.
He shone the flash light in the back and saw the shotgun, hmr and the .243 across the seat and said "whos owns the guns" driver said he owned one and that I owned the other two, never asked for licences just asked what we were at, we replied heading out lamping foxes...

His next sentence was the odd one,

"mind the old people" and walked off back to his car.

I think there just checking the unrecognised cars and jeeps around here after a few robberies

Same way idiots get driver licences!

Gonzo I would of told the Gard to go take a running jump.if u have permission and all ur licences and car tax,nct and insurance is correct then they can't do shight! If that was me I would asked for his sergeant to be called out there and then, see what the smug git says them!

It's a law? So if a gard tells me to shoot someone and I don't then I'm going to prison

No hes right Spunk. I said it to the father (hes a garda) and he said that if a guard moves you on and you refuse then they only way to sort it is in front of a judge. And I defo dont fancy that.

Besides, I kinda like to stay on the right of the gardai. It wont be too long till Im handing in licence renewal, last thing I want is the super to look it and say
"hmm isnt that the lad that give us all the hassle a few months back- hmmm what can I find wrong with this"

This all sets a very dangerous precident - if your lamping foxes on land you have permission for, then I can't see how a judge could find cause against you. I understand your point about wanting to stay the right side of the local gardai - but if their going to adopt that kind of attitude to an activity thats perfectly legal and above board then we are potentially looking at a very slippery slope that has implications for the entire sport:(

PS: Indeed the whole thing borders on the farcical - what next??, being moved on cos a guard objects to my choice of ice-cream that I'm about enjoy down the back of my farm??

i know that if a gards asks your to move on in the street and things like that, u have to but as my post says if your causing no problem and ur perfectly legal then wat can he charge you with:confused:

  • Closed Accounts Posts: 1,181 ✭✭✭landkeeper

but what's perfectly legal spunk ???i'd say if your down the fields there is nothing they will say to you , driving along rifle on the back seat lamp out the window  well that's just what they don't want to see, if truth be told that's what is going to **** it up for everyone anyway and the writing has been on the cards for that for along time as we all know .there have been so many threads about it at this point i'll be glad if they do clamp down might stop some of the eejits who drive around without a clue where they are who owns the land or what's on it :)

Is this provision under the "Public Order" act?? - I'd love to know how it could be construed against a landower or people with permission standing in the middle of an empty field at night going about their lawfull business:confused:

  • Registered Users, Registered Users 2 Posts: 4,777 ✭✭✭meathstevie

Being told to "move on" applies only to public places and in my opinion is mainly a prevention tool that offers plenty of carrot, as in wise up and go home, before the prosecution stick has to be used.

Theyd get you some way or other. One or two reasons I can think of just of the top of my head.

-Thats not a good enough backstop (reckless discharge)
-Ever hear the crack of a swift (noise pollution)
-Someone has horses or something in the field next door (worrying livestock)
-Someone down the road is acting the bollix and dialled 999 saying theres someone walking around with a rifle and they are scared out of their wits (public safety)
-lets take that gun for "forensic examination" to make sure it matches the gun on the licence and/or to make sure it hasnt had a barrel chop or you didnt put that spring and metal bar in that turns bolt actions into full automatics.

and then all the usual crap after that.

So basically what were saying here is that its perfectly alright to tell a guard to go and 'take a running jump' after he has asked you to move on when your out shooting at night.

That makes perfect sense, sur the guards will never ban lamping at night if they're told to 'take a running jump' every time they approach a shooter at night time - nice one spunk84:rolleyes::rolleyes::rolleyes:

Lamping from the road is a public place.
I don't agree with this law, but it is law.

A good friend of mine is a solicitor, his wife is a barrister. I remember we were drinking one night and he went on a 20min rant about the absurdity of it.

The way I remember it you could be reading the paper in your front garden and a Gard could tell you to move on :(

Well your not supposed to be lamping from the road anyway so if the gardai did come along you would want to be thanking your lucky stars that you only got "moved on" and not arrested.

You are allowed lamp from the road there was a thread about this not so long ago. You can't shoot from the road you mean.

you can lamp from the road BUT you can't lamp from the road from a motor vehicle looking for things to shoot , even if you intend to go into the field to shoot .;)

Im not going looking for it but i know it says about not been allowed shoot from a MPV... but yet its perfectly fine to shoot ducks from a boat with a motor attached which is a MPV.

Alright look at this way deeks, if you were the farmer of the said land and a smart arse gard came up to you,in you're field or lane and told you that he wanted u to stop lamping, what would u tell them to do? My point was that if u have everything in order and there is no justification for a gard to tell u to "go home " why should you?

All I'm saying is to use a bit of common sense when dealing with the guards, there's no point getting shirty and loosing your guns coz you couldn't hold your tongue with guard on a power trip. You'ld be better off just calling it a night and coming back another time.

If the farmer gave you permission he's kind of like your friend....
Guards pull you over and ask where you are going...?

    Your going to your friends!

This must of came down the line from CS, guards on the ground couldn't care less if you are going to shoot legally, but tell them your going to do what the instruction said not to do and your gonna hit a brick wall.
