No decision made by council before due date

    Hi, A friend of mine has planning permission with a due date of today. No decisions has been made or published by the council. They haven't been contacted at all. Is there a rule that says they have planning by default? Or can the council post the letter at any stage tonight? Half 6 now so I guess they're all gone home.

    I understand that they have a number of days to get it to you (i think its 3 days)

    Also have you allowed for the nine days of Christmas.

    Original due date was November I think but they had to apply for a 2 month extension of time. Does Christmas always come into it?

    Yes the offices of all councils close from 24th Dec to 2nd of jan and these 9 days are added to all applications including additional information or extension of time.

    There is one council in the West that (in my experience) always wait until the very last minute. It wasnt uncommon to get a decision hand delivered to our office on the very last day. There was a rumour about the application being granted by default if the LA dont reply in time but I wouldnt like to rely on it.

    More than a rumour Slig as its been law for some time now.

    Under the older 2000 Act PA's had 8 weeks to decide, refuse or request further information on a new planning application. Where none of these options were exercised permission issued by default.

    But under the new (er) 2010 Act PA's now have a further 12 weeks in addition to the core 8 week period to remedy a failure to make a decision.

    That's fantastic news - congratulations!!

    I've been following all answers here very closely a we're due to have our decision by tomorrow - the butterflies are so big at this stage I actually feel sick - it's that "Leaving Cert" feeling almost 20 years on!

    Lots of additional information - ah well, at least it's not a refusal and we can provide the information (although to be honest, I thought we have given them most of what they've asked for already!)
