There was a court case in the UK about this very issue. McVities wanted the Jaffa Cakes classified as a cake because the VAT on cakes is lower.

They won the case on the argument that biscuits go soft when stale & cakes go hard. As Jaffa Cakes go hard when stale, they could therefore be classified as cakes.
