    Hello All,
I was hoping for some advice regarding off duty gardai. How would reporting a off duty garda for Harassment begin. This incident may have resulted in the off-duty garda flashing his badge but refusing to identify his number or name? Thank you.

It either did or didn't result in a badge being flashed...it's one or the other so spit it out!

He flashed a badge. I ask for a id number he did not say name or number.

    Have you been drinking?

For all you know it could have been any Joe Soap who just flashed something shiny!

You don't have a name or badge number so basically you have nothing to actually report/make an issue of!

His name and id number are on the badge.

    Define harassment?

OP , your question really is academic - without a name or number there is no way you could make a complaint ( assuming a complaint is justified ).
Forget about it and move on.

I thought they carry an ID card , warrant card ? not so much a badge as such

There was some guy eating chips. Told him to pick up his crap off the ground. He flashed some badge. Did not show. We left him he followed. Then got into a scuffle with the guy he smashed his phone. On duty garda came and told us to move on while not doing anything to the guy who flashed a badge. Yes we were drinking. So I will probably leave it. Thanks all.

So a person can't even eat chips in peace now?

I can't understand your sentences. Did you smash the garda's phone, or did the garda break someone else's? Or his own?

If you've no details you've got nothing.

If you have any credible evidence to prove this person was an on or off-duty garda, you could complain to the Garda Siochana Ombudsman Commission and/or through your local garda station.

In order for harassment to exist, in either a civil or criminal law sense, the conduct would generally have to be persistent. This seems to have been a once-off, given that you don't even know who "harassed" you.

You were also intoxicated at the time, so that's not going to encourage anyone who relieves your complaint that there is actually anything further to it than a brief scuffle.

What badge ? A badge that showed him to be a paid up member of the Land Rights For Gay Whales Action Group ?
You don't even know what badge he showed , he did not claim to be a Garda.
In fairness to the Gardai there seems to be nil evidence this man was a member.
