Waiting for settlement offer from Injuries board

    Hi all

    I had a medical examination with the injuries board 5 weeks ago concerning a personal accident which i had last year. I have recovered well from the accident. The other party in this case has admitted liability. It is now just a case of trying to come to a settlement figure. Has anyone any experiences with regard to how long the Injuries Board generally take before making some sort of offer to settle. Your info would be appreciated.

    They make an Assessment, not an offer to settle and you or the other party can reject it.

    They have 9 months to make the Assessment.

    Consult a solicitor before deciding to accept the Assessment.

    Yes i should have referred to it as an assesment earlier. I do have a solocitor, and have been advised that it could take up to 9 months for an assesment to be made. What i am trying to figure out is what is the usual timescale for the Injuries Board to make the assesment or do they leave it go the full 9 months?

    It varies, depends on the complexity of the injuries and prognosis and indeed how busy they are.

    Expect a 5-6 month wait anyway.

    I got my assessment done, settled with the company I claimed against and had the cheque in my hand within 3 and a half months. That said, I have heard of many others waiting 6-9 months, so I must have been an exception.

    From what ive read, typical running time is 7 months at the mo. This is after the insurance company have indicated they are not disputing liability.

    As pointed out cases differ depending on different factors so treat it as a general idea.

    Vanilla process is.... Injuries board application made, respondent contacted and have 90 days to accept or dispute liability. Assuming accept. Up to 9 months with piab to either determine a proposed compensation figure. Once figure sent to both parties. Respondent has 21 days to accept/reject proposed figure (default if no response received is accept) and claiment has 28 days to accept/reject figure.... Default is reject if no response received. After that piab issue an order to pay to respondent.... I believe it has to be paid within 21 days.
