Hypothetical situation. An individual is charged with a criminal offence. The charge is dismissed under the probation of offenders act and the accused is required to submit finger print and photographic detail at their local Garda station. Does this constitute a police record such that if you were ever asked 'do you have a police record' you would have to answer 'yes'!

    It is a police record.

It is not a criminal conviction

what if you were arrested ( photographed and finger printed ) for something you didnt do and a file was sent to the DPP but no summons was brought against you , would your arrest details show up at the likes of immigration during a trip overseas to usa , canada etc ?
