Underage Criminal Damage

    Hi All

    Long time lurker first time poster, hubbie was driving home from work a couple of weeks ago when a rock was thrown at the car, bounced off roof and onto bonnet, long story short - got the boy who threw the stone, phoned police, parents contacted us that day and said they'd pay for damage, got a mate of a mate to give us a quote to repair damage for a couple of hundred euros, contacted parents, and for the past couple of weeks they have made up every excuse not to pay, they wanted a written quote - mate wouldn't give one cause of social welfare crackdowns, anyhow brought car to garage and they said the bonnet would have to be replaced at a cost of €1200, arranged to meet up with but they never showed, got back in contact with Gards and they basically said nothing can be done, anybody have any advice cause it's making me really angry now, that boy is getting away scot free and nothing can be done

    As for criminal charges it depends on the boys age.

    Just take a private claim against the parents.

    If he is under 12 years of age he is not criminally responsible, Above 12 to 18 he would be dealth with under the provisions of the Juvenile Diversion Program.

    Hi All

    Thanks for your replies, the kid is 13 years old, tbh I just want the car fixed, the kid in question hasn't even apologised for the damage he did, it's really frustrating now, I've contacted a local solicitor to see if there is anything that can be done, on a different note, my 13 year old has just come home from delivering leaflet for the local shop and he was tripped and pushed around by a group of youths, what is wrong with these kids!!!!

    In relation to your car, if you're in Dublin, walk into the district court office in the four courts and they will help you out on how to issue a civil summons.
