    What a mess. :D

    The Government, under Section 122 of the Broadcasting Act 2009 may 'acquire' the national Airwaves for broadcast purposes on demand ...in case of Major Emergency which in Ireland requires a state of Emergency to be declared. Except Enda did not invoke 'major emergency' privilege or declare a state of emergency.

    Therefore the broadcast was deemed a party political matter by RTE.

    Consequently FF SF and the Technical Group are entitled to address the nation too. The Technical Group, I have just been told, will give their 10 minutes just after the 9 o clock news slot to Ming The Merciless. :D

    The unprecedented move to allow Fianna Fáil, Sinn Féin and the Dáil’s technical group to respond to last night’s statement by Mr Kenny arose because the Government did not invoke the terms of the 2009 Broadcasting Act. Section 122 of the legislation empowers the Government to direct a television station “to allocate broadcasting time for announcements for and on behalf of any Minister of the Government, in the event of a major emergency”.
    In the event, the Government simply requested airtime from RTÉ. The national broadcaster agreed and then also felt obliged to split 10 minutes between other parties.

    Emergencies cannot be declared retroactively either, no matter what that hyperactive Shatter fella says.
