Penalty points uk

    My brother got caught by a fixed camera yesterday. He is living in northern Ireland. Has a northern Ireland car and full uk licence.
    He has his full licence exactly one yr. the law states that if you accrue 6 points in the first two years your licence is revoked.

    His worry is, over 3 yrs ago whilst on a provisional he was handed 3 points. The offence is over 3 years from the new one whilst the conviction date is just over two yrs.

    Does the 3 new points equals 6 or are the old 3 expired thus keeping him at 3?

    Perhaps in wrong section so feel free to move this.

    Penalty points on your provisional licence
    You can also get penalty points on your provisional licence before you pass your test. These points last for three years and will count under the Act. If you reach six points before you’ve taken your test, your provisional licence won’t be taken away. But if you get any more points within two years of passing your test, you will lose your licence.

    Ok, it's looking good so far for him. His original offence happened aug '08. He was convicted April '09. Does it go back to the offence? If so its over 3 yrs and he should b clear. if not he's facing a ban is he?

    Not sure. If it's the same as here the points are only put on from the date conviction/payment of fixed penalty, not the date of the offence so he may be unlucky.

    I'm pretty sure that in GB it's from the date of the offence. I presume NI is the same as GB.

    Yeah you're right. depends on the offence though looking on direct.gov. The date of conviction ones are fairly serious ones though. Most run of the mill offences are from date of offence. Seems you your brother is ok OP

    His provisional had expired was the first offence.
