    Hi to all,

    Im just wondering if anyone can offer me some advice in the following situation - Myself and my husband are jointly assessed. I have not been in employment this year due to the recession.

    A few days ago i logged onto PAYE anytime to review tax credits and i found that the revenue have been giving us the home carers credit from the beginning of this year. I immediatley removed it from our credits because we are not entitled to it, having never been a carer, it was a mistake on the part of the revenue.

    My husband came home today a zero amount on his payslip, further more owing his employment 17 euro, as he was paid yesterday he will not receive wages next week. Can the revenue deduct all this in one amount even though it was their mistake? is there a way of paying them over a period of time? since i am not working and we have a mortgage we really need this wage. Has anyone experience of this? i would appreciate all feedback, thanks in advance.

    Why did you cancel it? Do ye have any children in the house? If so then you would be entitled to it this year:

    Conditions to Qualify

    1. Married couple - must be jointly assessed
    2. Home Carer must care for one/more dependent persons
    3. Home Carer's income must not exceed €5,080 for the tax year.
    Note: Carers Allowance from Department of Departmemt of Social Protection is not taken into account for determining restriction, but is a taxable source of income.


    A Dependent Person

    1. Must not be a spouse
    2. Is a child for whom Departmemt of Social Protection Child Benefit is payable
    3. Is a person aged 65 years or over
    4. Is a person who is permanently incapacitated by reason of mental/physical infirmity.

    Sorry to hear about your problem. As far as I'm aware, revenue normally give you the opportunity to repay any money owed to them over an agreed period of time. I think you should talk to revenue early next week about this. I'd be surprised if they did not try to accommodate you in some way. Hope it works out.

    Home carers credit is applied automatically in joint assessed cases where there is a dependant child on file and only one employment listed at the start of the year. If you have a dependant child (in receipt of child benefit) you are a carer.

    If the above is actually your situation then you are entitled to the credit.

    If you are sure that you are not entitled to credit, it cannot be reversed.

    The reason that Revenue took the whole amount back is when you remove a tax credit online during an active tax year a new tax credit cert issues on a cumulative basis to the employer meaning the employer recalculates everything from the start of the year in one go. If you want to remove a credit during an active tax year contact Revenue via the 1890 service or email and that it be removed on a week one basis rather than a cumulative basis.

    thanks for the replies guys - yes we do have a dependant child in receipt of child benefit. I removed the credit because i didnt want us to get into trouble for claiming for a credit which we shouldnt have.

    I foolishly thought the credit was in relation to caring for a dependant adult. I will contact the revenue regarding this immediatley. Thanks again for the most helpful feedback.

    I suggest you go back in immediately and re-claim the tax credit using paye anytime .

    If it only took a few days to process a removal , then it should be re-instated within another few days .

    That should be the fastest way to sort it, and when it's sorted and a tax credit cert reissues your husband should then get a double week's wages next week.

    Reclaiming a credit online that you have only recently removed online could lead to the claim being held up for a manual check. To be on the safe side ring the 1890 service Monday morning and ask them to put the credit back on. Make sure you get them to put back on a cumulative basis. They should do automatically but you never know.
    Also have your husband contact his salaries section on Monday to advise them that a new cert will be issued shortly so they can keep an eye out for it.
