Honest Mistake

I've heard that there is a part of civil protection legislation that in the event of an honest mistake.

An example might be being prosecuted for shoplifting, it may be an honest mistake that you forgot to pay for one item out of fifteen and if the shop has a zero tolerance policy they might prosecute you?

I know that things like this are used by people as excuses but in a genuine case, especially if say someone went back to the shop, or offered to pay for the item after being caught, but the company still wanted to prosecute.

I for example am on medication, one of the side effects is short term memory loss, I don't know how many times I've gotten out of bed at 2am to check if my car is locked or alarmed because I honestly cannot remember doing it. Sometimes it is sometimes it isn't. In order to remember little things like this I have to repeat "the car is locked the car is locked" before going into my house. I have also accidently forgotten to pay for something and only realised later. But I'm worried, considering that I will be on this medication long term, and I am by and large an honest person, that I might run afoul of some entity.

I once misplaced my drivers licence for a week and was freaked out about running into a checkpoint. Things like that.

    Advice would be helpful.
