Humm how to follow the rules on this boards??
Im looking for someones opinion, advice or a story about representing yourself if there were to be a bench warrant issued for arrears in maintenance and if the court is on say, Tuesday, and the creditor has represented herself so far as its been ok but doesnt have a clue about bw's ?!
If having managed to go through the maintenance recovery steps and getting nowhere ( arrears are continuous over the past 12 months)and if the judge got really p'd off with his guy not showing up and say a softy mother doesnt have a clue what to do, would you comment here that a solicitor would be a good idea or would she be able to handle it herself??

I think your post could be more clear - from reading it I'm unsure are you the person seeking a bench warrant or is the bench warrant against you ?
Do you owe arrears or are they owed to you ?

In any event legal advice is not allowed on boards and as for representing yourself I know that most people here would counsel against such an approach.

Have you applied for legal aid?

If not eligible have you considered the benefit legal representation would bring against the cost of paying for a consultation and one or two appearances?

Sorry, i'm new to this and am currently very distracted. I'm not looking for legal advice as i read the rules of the board. What i'm looking for is someones experience and if its allowed for someone to explain what happens with a bench warrant hearing for arrears in maintenance if its happening tuesday , and tuesday is not family law day its a normal court.

I'm the mum, and my son's dad owes arrears for over a year and i wasn't very sure what a bench warrant entailed it only got issues on friday- i know he won't get carted off to jail and i'm aware from searching the boards here that the arrears won't get sorted with a magic wand tuesday.

I had a solicitor before and by the time i paid her , there was very little left in the arrears. Two years ago with the recession and reduction in work as i went on OPFP i got legal aid but it still cost €310.

Its been fine representing myself up to now- but as the last time it went to court under a bench warrant we both had solicitors and i just had to sit there, this time is obviously different and I was wondering if anyone has gone down this road before and represented themselves when the arrears in court came to a bench warrant- is it different to the regular arrears hearing??

Well just to let you know it went fine. The Court Clerk is super nice and helpful.
i represented myself again and it was great. Saved a few Euros on a solicitor!

Delighted to hear it went well and hopefully you'll start getting maintenance ordered.

Hi there, I am an independent radio producer hoping to make a programme about people who decide to represent themselves in court. If you have gone through / are going through this experience and would like to talk about it (anon if necessary) please get in contact. Thanks
