caught speeding

    Ok long story short............

    Driving back from passing my nct I got caught doing 78km in a 50km (outside commoms inn) just outside cork

    1. pulled in by garda May (22nd), he checked NCT,TAX,INS and asked for my license...... no problems

    2. Garda didn't give me the normal chat (points, fine etc) said nothing to be honest

    3. didn't receive notification of a fine in the post and didn't want to go through the hassle of a day in court so I called into my local Garda Station 3 times after (1 month, 2 months & 3 months)

    Each time I was told that I didn't have a fine......... they couldn't find anything on the system so I thought "nice one" I got away with it!


    Received a registered letter yesterday *summons* ..... turns out fine was logged last june

    So once again I call into my "local Garda" station today (with summons)

    20 minutes later I'm told I don't have a fine on my name/reg and more or less F*** O**

    I explain I must have a fine on the system as I have a summons, after 30 min...... oh yea I spelt you name incorrectly..... WTF how difficult is it to type a name?

    Anyone else have an experience like this? Anything I could go to getting out of taking a day off work for a ****ty day in court??

    Only in Ireland... Remember back in '09 when they were looking for prawo jazdy?! They had clocked him 50 times before realizing that they took down the incorrect translation! 50 convictions over smoke.

    You could sue for damage caused by distress arising out of this incident. Alternatively, consider making a formal complaint to the superior of the Garda in question.

    ^^ Eh don't do this OP, take the day off work and get it over and done with. If you are not present in court the judge will think you don't give a toss and will probably give you a big fine and points.

    It's waaaaay more comical than an incorrect translation.

    Prawo jazdy is Polish for driving licence.

    music to my ears..... I been caught twice in 21 years, both times outside the commons inn :mad:

    So does any one know if I can get out of having to take an unpaid day/afternoon from work?

    No he isn't. His problem is that he tried to pay his fine in June and they told him he didn't have one, now he has to take a day off work to go to court because of their incompetence.

    No, he would have gotten a letter then about his fine. How else would he know? He said he got no letter, unless he is living at another address for some reason to where the car is registered, I cannot see how this is a surprise.

    No fine received, summons struck out. Seen it happen 100's of times.

    I did read it in full, I was just trying to say that perhaps you are getting a summons as opposed to a fine since you were a considerable amount above the speed limit.

    So after your call on 1, 2 & 3 months they spelt your name wrong too? That sounds a bit odd to me. I thought they logged every desk enquiry in their book too so why don't you follow up that? The Pulse system (if operational) would have auditing on too so I would think they can back track every search done.

    All siad, reckon you will just have to take the punishment but if you got all your facts together you may be able to persuade judge to just give you 2 points.

    I never said they spelt my name incorrectly on the 3 previous visits...... just that I was told the fine wasn't on the system.

    I'm Irish but I do have an unusual name and I always make a habit of alway clearly spelling my name if asked, its even spelt incorrectly on my driving licence

    I haven't had the pleasure of visiting a Garda Station on too many occasion so I don't know, all I can say is that my visits did not get logged

    Dude, sorry if it seemed like I was baiting you earlier, but you should really get your licence fixed. I don't think it's valid if your name isn't correct. Or it can at least cause complications at the very least.

    no worries, license is almost "out of date" but I will look into getting it fixed

    Maybe that's the problem that it's not spelled correctly on your driving licence, so fine was issued for incorrectly spelled name.]

    fwiw pretty well everyone does approaching 78 km/h past the Commons Inn, Im only amazed I never saw a trap there as the limit there is so universally broken.

    Nonsense, never ignore a summons the miss spelt get out of jail free card is as much a misnomer as the 'Garda not wearing his cap' urban myth. As I have read here and elsewhere the Judge will often amend the summons to reflect the mistake. The OP has admitted that his name is miss spelt on his driving licence, up to him to correct it free of charge.

    The admitted 78kph in a 50 zone, no matter whether or not people agree with the limit might be considered by the judge to be a wee bit on the excessive side and I would advise the OP to appear in person as much to explain that he did not recieve any notification and also to apologise in person. The personal touch is something Judges like to get.

    No notification means he gets away with it. I would not be appearing to admit anything in those circumstances.

    Name is spelt correctly on the summons, Garda asked me to confirm my name on the day of the fine. Problem I have is they didn't listen to me when I called into the local station even after clearly spelling it at least 3 times on each occasion

    Yea its the first 50km zone coming into the city from Limerick, its more or less impossible to keep below 50km. They were hiding behind a crash barrier......

    Shouldn't that be at 50km/h. Driving slowly shows lack of progress on the driving test and will result in a fail if you consistently do it.

    I think, kuro2k will have to go to court and argue the case that he didn't receive any notice of a fine. Though the real part that sucks appears to be this part of the road. **** as it may be, the limit is the limit and it's probably there for a reason, not just to catch people out for money, similar to speed cameras being in places where accidents have occurred due to speeding.

    Never seen a speed trap there either. Nobody does 50 there for some reason..

    The speed limit is being revised to 60km/h, it can't really go much higher because there are private entrances, pedestrians, traffic lights, etc.

    none of your links are at the Commons Inn oddly.

    I would hazard a guess that noone not stopped at the Commons Inn traffic lights travel at or below 50k and the vast majority are over the 60k. Certainly I slow down by a token amount on entering the speed limit but always get passed out by multiple vehicles (most of whom I had just passed out on the 100k section!). After the lights heading towards the city I keep to about 60k or a little over and again, multiple overtaking occurs, theres plenty of cars doing 78 k Id say.

    60 km/h as the limit will at least mean there is less chance of getting a ticket. There are multiple entrances and side roads so it really would be a sensible limit I agree. Of note , they have extended the hard shoulder by the McDonalds petrol station to prevent right turns into it, which I guess is part of the changing the speed limit.

    Further in to the city by the Brewery, a set of lights and a yellow box have been installed where you turn for McCurtain St. I don't really know what function this has as few people come out from the city and right turn there. It seems to cause unnecessary delays but is handy for the few pedestrians I guess. I wonder if this work is a precurser to shutting off some of the smaller rat-runs closer in to the city?
