Close Farmers Gate or Leave It Open

    Hi all. Looking for some advice. Having a nightmare with a farmer who rents all the land around us. Bought this property 5 years ago. From day one this farmer was quite aggressive (long story - there was a family dispute over the house we bought and he was involved). But we tried to keep the peace and we were very amicable with him. Fencing was non existent. All that was keeping his cattle in was a gate further up our road and his cattle were constantly coming into our land. We paid for and fenced his land so his cattle wouldn't come into our property. He never even acknowledged it. Anyways, the gate is on our right of way and this year he dug up the edges of the road with a digger and the road around the gate is a swamp. His cattle kept breaking into our lawn this year and a bull landed one day. I phoned him one evening as we had had enough and said "you're cattle are in our lawn, can you get them out". He said he wasn't around and when I asked him what we were to do with them he said "do what you like with them".
    To try and cut a long story short, he tried to blame another neighbours cattle and the neighbour he blamed was the man who came up to help us move his cattle that same evening.
    Again to try and cut a long story short, a row ensued the following morning and the Gardai were involved. It's a total nightmare.
    My question now is am I obliged to close this mans gate when the road around it is a total swamp due to his digging. Surely he has to maintain the road. We have maintained it over the years, filling potholes etc. Sorry for the long long post. Any advice would be appreciated.

    There are lots of issues that could be there regarding the right of way.

    You should really see a solicitor and get legal advice regarding what you can/can't do.
    It sounds like a cop-out, but I've been in enough of these cases to know that it's almost never straight forward.

    Get your solicitor to send him a letter. Also tell him that if any further damage is done to the lawn that a landscaping company will be called in and you won't be paying them
