Received fines for scrapped car!

I received 2 fines in the post today from an Garda Siochana for non-display of tax and parking on a double yellow line on the 1st October 2011.

Only problem is I scrapped the said car for a Renault Fluence in July 2010!
I rang the guards and they are sending me out a form to declare I am no longer the owner. I asked was it a green '96 Merc and they said it was, so it's not a case of false plates - it is the actual car!
I rang the dealership I bought the Renault from and they are investigating and ringing me back.

I handed over the log book to them in July 2010 and they were under obligation to send the car for scrappage.
So, what is the likely scenario?
Did they sell the car on or is the scrap yard responsible for not fulfilling their end?

Shouldn't you have gotten either a transfer of ownership cert, or a scrappage cert (not sure what the actual names are)?

Sounds like they sold the car on.

They're obliged to supply a disposal cert in order to redeem their scrappage monies. They could get in trouble if they didn't scrap the car or obtain a disposal cert.

Maybe they got more selling it on?

Possibly but its a pretty serious offence imo.

Sounds unlikely that a main dealer would risk this kind of activity. My money is on whoever was contracted to scrap the cars.

When you sell/give a car the garage has to give you some form of receipt, a particular form with a particular code that I can't think of - but they keep the log book (collquial reference to the Vehicle Licencing Certificate (VLC)).

If you're selling the car privately, the VLC becomes much more important because that's the only document that changes hands.

One of the two would be in a bit of bother had they not scrapped the motor. Personally I'd make a holy show of the responsible party.

How so? I'm sure they are well within their rights to give the customer the scrappage price but sell the car on and not claim the vrt reduction from the government.

Not nessecarily. The idea of cloning the plates is normally to put it on the same make model and colour of car, otherwise it'll most likely be piced up quite quickly the first time it goes through a manned anpr system or a toll bridge.

Exactly what I think happened here.

Hang on , you chopped it in for a Renault...Renault were offering all sorts of scrappage deals, did you qualify for the official Govt scrappage (ie did you meet the tax, insurance NCT ownership requirements?

I have to agree they wouldnt be obliged to chop it in if they were willing to forgo their dosh back from the Govt.

My moneys on a clone though.

Whenever you sell a car for scrap if they cant give you a disposal cert then they should get the tax book signed over to there name etc...keeps you from getting into any bother imo.

    Thanks for all the replies.
The dealer has just rung back and will be sending out a copy of the scrappage cert. He rang the yard and was invited up to view the scrapped car himself.
So, it sounds as if the plates have been applied to a similar vehicle.

If the ELV was issued why is it in your name.

So you traded it in in June of last year, and the scrap yard still has the scrapped car lying around?
Can't see it tbh. I reckon someone's been caught rotten.
