damage to property from estate under county council

    Hi,
    Would anyone know what is the position with a council estate that was built behind a private estate about 5 years and in the past couple weeks a spate of stone throwing from that estate has caused damage to a few of the private houses. (obviously next to impossible to prove unless one could catch the stone throwers but clearly they are coming from that estate) Does the council owe a duty of care to protect the private houses and can the private residents get compensated for this damage?
