Am I in the wrong here??

I got onto Eircom earlier in the year (online service) and requested Broadband. Filled in the form with my detalis ie, name and address etc and looked forward to finally getting some decent broadband in the house. A couple of weeks passed and the first I'd heard from Eircom was a bill that came through the door looking for over €100 for the phone line they connected. Now I'd have no problem paying for the phone line if the service I required, The broadband was also provided, but as it turned out there was no broadband in the house.
I sent the bill back to Eircom and told them there must be a mistake as I never got the broadband that i requested.

the bills kept coming and i kept sending them back with the same note, saying I won't be paying for a service I never received. last week a solicitors letter came in saying Eircom want their €130, so i rang Eircom and they told me i have no grounds for a complaint as i agreed to their contract.

Am I in the wrong?? I request broadband, don't get it but still have to pay for a phone line that is only there for broadband, which never came??? I agreed to their contract, but did they keep up their end of the deal?

To be honest, I'd rather not go to court, but at the same time I don't want to pay this bill as I feel had they kept up their side, even contacted me to say there is no broadband and asked do i still require a phone line, then it wouldn't have came to this.

I was in a similar position when I moved into a new house - I wanted broadband but they where unable to tell me if it was available without first installing a phone line which they subsequently did and confirmed I could not receive broadband in my area.

As I did not need a phoneline I then cancelled but still had to pay for the installation of phone line despite no broadband. Felt cheated but still paid - read the small print and they had themselves well covered.

I refuse to pay it, and sent them a letter to tell them so. I understand you felt cheated, as do I.
I'm still waiting their response, but am prepared to go to court with them over this.

As I understand it, You accepted their contract on the basis that they would provide you with a certain service. As you never received said service they would be in breach of the contracts conditions.

Op head into a citizens information bureau and speak to someone in there, give them all the information and check the terms and conditions of the contract you agreed to.

This doesn't make any sense. Do you have broadband or not? Also, how did you find out that you didn't have broadband?

The part before your copy and paste there says "i'd have no problem paying for the phone line if the broadband was also provided". I received a bill for the phone line but not broadband, as there is no broadband in the area.

So eircom....who own the exchanges and the cables in the ground could not tell you if they could actually get broadband to your house across equipment they own....you were scammed and should not have paid up...in my opinion.

Did you order the broadband and phone together? And more importantly did you make any phone calls on the line?

I had a similar problem, got a phone line installed and no broadband available in my area, but I didn't tick broadband when I ordered my phone line. I stupidly thought that living beside a modern industrial estate with lots of tech companies in suburban Dublin it wouldn't be an issue. Little did I know that they had me on a different exchange and I was too far away.

When I rang Eircon to complain about having to pay ~€120 to get a phone line installed that wasn't capable of broadband was a scam. The person who I was talking to said that if I'd ordered BB at the same time as my line they could have told me it wasn't available, not sure if I believe them. In the end I had to pay for the engineer call out and 2 weeks line rental.

If you made any calls on the line you've no chance as Eircon send you out a letter a few weeks after you get the line that you need to sign and agree to their T&Cs. But it also says that by making a phone call you agree to the T&Cs.

OP: Contact Comreg, the communications regulator, I had a problem with a mobile broadband operator, and the sorted it out for me. They will look after you.

At no point did Eircom promise broadband this is your problem, their not billing for broadband their billing for a phone line that had to be installed to see if you could get broadband. (Now they should know before they install the line if the broadband will work but they never seem to do for some strange reason).

Comreg is the only way to go on this one.

I haven't paid up, and to be honest I'm waiting on the Court letter dropping through the door now.

I never put a phone anywhere near the line and never used any service that I never requested. They sent a letter asking me to send all their equipment back, equipment that I had never seen
