strange way to be made redundant.

    so been working for a company in england for 12 months,today 14 of us were called into office.(all at once)told six will be kept,the rest let go in a fortnight,we all have an individual meeting next week with management.

    this meeting is for us to state a case to what we can offer the company going forward,then by the following week a decision will be made.

    my feeling is that they know who stays and who goes already,really cant be certain if i will be kept or not,if it was purely a production based decision i would be staying,but i feel politics will play a big part.

    just wondering if anyone has any expierence with this type of scenario,and is it legal?

    It's legal afaik,
    All 14 of you have effectively been put on 2 weeks protective notice. An employer is then entitled to decide who to retain and who to let go, so long as they don't discriminate on race, religion, etc, or breaches any terms of your contract/works agreement that affects redundancy.

    I also think the protective notice also forms part of any minimum notice period stated in your contract.

    Sorry to hear that this is happening to you. I've been through it myself this year.

    Unfortunately, what is happening is that your employer is engaging in a consultation with you. They are giving you a chance to state what you can offer them - perhaps you have other skills or abilities that they were unaware of.

    I'm sorry to be a bit cynical about this but its' an ass covering exercise on their part that ticks a few legal boxes and keeps them in the clear. It is quite likely that have made up their mind on who is staying or going.

    thanks guys,
    well we (me and fellow immigrant)decided to go to our md and seek clarification on what was going on and after speaking with him found out that we indeed were 2 of the people who would be leaving(sub-ing rest of work out and only keeping lower paid staff directly due to time frame left on job,due to finish in april 2012,defo wont,but was starting to be a strain because of conditions nyway,so happy to be back home.
