As the original thread has been locked I thought some of you would like to know how this panned out. Well the "dead filly" has been returned to it's original owners. The couple who bought it from the trainer returned it and to the best of my knowledge are to be reimbursed the purchase price. The legal advice was that it would be too costly to pursue the trainer for damages as most likely he would offer something derisory like €50 a week saying that would be all he could afford. He most likely would have had his license revoked but I don't believe anybody wanted that. So I guess that will be the end of the matter.;)

Cheers for the update, was hoping you would get back with the outcome.

How on earth the trainer taught he would get away with this is incredible, although he obv taught the horse would not be going back in training.

In the other thread ppl were asking about how ownership could change hands without the owners knowing, well as fare as im aware there is no official documents of ownership of a horse, only a passport which the trainer would of had. Makes it fairly easy for such thing to happen then. anyways all is good again.

Great that they got their horse back, do they plan on running the horse again? and hope this hasn't turned them off racing.

Because they had no reason to doubt what the trainer had told them they never looked for the horses passport. So as you rightly say once the trainer had the document it was simple enough to move on. Still I'm sure there had to be some proviso that she wasn't to be raced again. Anyway I don't think she will race again as she was of very limited ability but if she does I'll let you know. Herself and their other horse are grazing happily in a field not far from me at the moment. The plan is to wait until spring for their other horse to return to training as it wouldn't appreciate winter ground. With a different trainer I might add.:P

I would have gone ahead with legal action. A trainer like that doesn't deserve to be training.

I would have pressed charges as well, or at least gone public on it, the trainer has taken advantage big time of someone who was putting bread on his table.

im not sure how long the horse was "dead" but they have lost at least a season thats effectively 15-20% of the horses racing career.

terrible carry on, disgraceful and really the licence should be revoked as they are not a fit person to train.

The OP wont be naming the trainer as the entire story is bull****.

No trainers' names (or horses' names) will be mentioned in this thread...
