Text messages as evidence.

    Just a quick question. Can text messages be used as evidence in court. Are they taken seriously? I have over 5000 aggresive texts on my phone and would like to know if they are usable in court.

    Harassment would be the charge. Texts can be evidence if it can be proven who they are from afaik. You should really change your number.

    its not really a charge more in a custody hearing?

    Perfectly understandable that one might wish to use anything to get even with ex-partner.

    But parents should try to exercise the greatest possible restraint when it comes to dealing with childrren and custody battles.

    As a teacher, I have watched a family being torn apart and children's happiness being utterly ruined by two parents who would do anything to score points on the other partner.

    Highly intelligent, talented, fun-loving, sociable youngsters turned into unhappy, disruptive, under-performing, unsociable children totally lacking in confidence.

    I have also seen separating parents do their best in the same situation not to allow their differences affect the children any more than was necessary in such circumstances.
    The children in the second situation had access to both parents who always spoke with respect of their estranged partner, and always included him/her in matters relating to their children. Although some impact is inevitable, the children coped relatively well with the separation.

    I do know that it is easy to offer advice, and we do not know the full circumstances, but remeber that your ex-partner is your children's mother/father and they want to continue loving and trusting that mother/father.
    If at all possible, don't deny them this.

    Yes text massages can be used as evidence. Personally I'd see it as a claim under Section 10 of the Non_fatal Offences Agaisnt the Person Act 1997 : Harrasment via text massages...
