What can happen ??? S-Class Merc written Off !!!

A friend of mine drives a 07 S-Class. While he was away, he left it with his daughter. Last night, I got a call from my friend's son. He told me his Dad's Merc was crashed. Immediately, I drove to his house, where I met his son. He explained to me that, his sister's boyfriend had taken the keys and brought it for a spin. He's 21. I drove to the N32, where the crash happened. The car is a complete write off. I explained to the Garda that the owner of the car was away, and his son was left with the car. Oddly, he didn't try to call the owner.
He believed me straight away, I wasn't lying anyway. He explained that whoever was driving tried to do a handbrake turn, but hit a pole and it threw him in the other direction, hitting another car (Nissan Almera) and some how he landed the car on its side. The guy who recovered the car said it was definitely written off.
The 2 rear wheels are bent inwards. And chassis damage aswell as the body damage.

What charges can be brought against the guy who took it ? He has no license or insurance. And took it without consent. Any other charges ?

Also the owner of the car, my friend, wasn't informed about this by the Garda.
Should the Garda have to tell him ? He be home from his trip tomorrow, midday.

Any advice will be much appreciated

    Thanks in advance

Without consent of the owner or without consent of his daughter?

Good lord he's in for a nasty surprise tomorrow...

If there was no consent given i'd say that would be classed as theft. Other charges could be driving without a license and driving without insurance. Either way, the guy who wrote off the car is in deep trouble.

His daughter wasn't in charge of it, his son was. But, it was left in her garden.

no insurance, non display of insurance, non production of insurance,
no licence, driving without a licence, non production of a licence,
unauthorised taking of a motor vehicle (theft),
    dagerous driving,
and possibly a few more such as breaking a red light, driving over hatch markings, failing to stop etc etc if the guards where following him.

it doesnt matter who was tasked with minding it, if the owner didnt give the driver permission to drive, its theft.

and he will need to make a statement to the guards for a theft charge to go ahead,
if he doesnt, and says he had given him permission, the guards could do the owner for allowing him to drive with no insurance and no licence.
and theres a good chance he wont be able to claim from his own insurance or the motor insurance beuru if thats the case.

He left in son in charge of it yet it was in his daughter's garden. I suppose the son and daughter live in the same house though? If not that's some fecked up story tbh. Where did the lad get the keys from, the son or the daughter?

OT but doesn't the S class have an electronic handbrake?

Taking a car for a spin is one thing, this is just joyriding

once the keys were not in ignition, which was the case here, the car was taken without consent, the lad that took it is adult at 21, and had no respect for said car, nor other road users, as he did a handbrake turn, he should face the music

Both son, daughter, my friend and his wife live in the same house. Last night, his daughter and her boyfriend were left in the house while the son went off to do something. When he got back the car wasn't there. His sister was, but her boyfriend wasn't. She says he just went to the shops to take it for a spin, about a half hour later he's not back, and the the son gets a call from a Garda saying the car was on the N32 and the driver had failed to stop for police etc. So he called me, and we both made our way down the the car.....if that makes sense

Why would the son ring you, and not his father. Why would he even have your number?

Fess up, are you the son, or the friend that was driving?

    well hopefully he dies.
i would say hopefully he is left with a dibilitating injury but then he would only be a further waste of space and drain on society.

it makes no diff if the keeys where in it or not.

To be quite honest it doesn't tally with your first post. did he fail to stop for police before or after he attempted the handbrake turn? Presumable before as the car ended up on it's side after the turn? So after refusing to stop for police he decides to attempt a handbrake turn?

    Sounds well weird to me.

LOL, he called me because he was supposed to mind the car and let NOBODY in it, which he did, only to be let down by his sister. And he obviously thought his Dad would kill him

He probably lost control of the car. Whether that happened because he pulled the handbrake or was just continuing the trend with his absolutely mental behaviour we can't be sure.

If I were the owner I'd tell the garda that he didn't have consent and go ahead with theft charges. Hopefully the little muppet will get some jail time...

He couldn't be anything more then a brain dead moron tdo do something like that anyway.

I think he tried to turn it and go back up the N32 towards the Bewleys hotel...not too sure. But he failed to stop for police.

the lad who took it is fúcked basically , hell probably either be done for theft , or at best case driving without a licence, no insurance and dangerous driving.

tbh if i was the da he wouldnt even be able to walk let alone drive ever again but thats just me , very very very very very stupid lad

I hope he gets charged with most of those, teach him a lesson anyway. He should count himself extremely lucky that he didn't kill anyone.

Can you even do a handbrake turn in an S-Class, I thought the'y had an auto handbrake?

I got that feeling too reading the op, "he believed me, I wasn't lying" and the questions about the Garda informing his friend and when he'll be home, something seems off.

Either way op, whoever was driving the car is in a heap of trouble with the law and the merc owner

Like I said before, He pressed the button for the handbrake, and tried turning it around, but he hit a pole and that threw him the opposite way into another car.

So between you posting those two posts you went from reckoning he pulled a handbrake turn from the skidmarks on the ground to knowing he pushed the button for the handbrake.

fairly sure the handbrake wont come on while you are driving in gear with a push of the button like that.

Because you'd struggle to find two of his posts that agree with one another.

  • Closed Accounts Posts: 135 ✭✭Ensti

    Right, I'll put this right.

Last night, the car was taken from the owners garden. Where THE OWNER, HIS DAUGHTER, HIS SON AND HIS WIFE LIVE. The owner and his wife are away. So the daughter, the son and daughters boyfriend are left with the house. The son goes out. The daughter's boyfriend takes the keys and takes it for a spin to the shop. Garda attempt to pull him over on the N32. He presses the handbrake on and tries turning the car around, he hits a pole, and that throws him in the direction of another car. The police arrest him. Police calls owners son (The guy who took it says he was supposed to mind it for the owner). Police man explains what happens and where it happened. Son calls me and explains it. Tells me to come over. I come over. He DOES NOT call his Dad.
And we make our way to the crash were the police man tells us what happens, again.

No, it wont but if the muppet driving expected it to lock the back wheels like a traditional handbrake, its very possible that he threw the car into a state of uncontrol in his attempt at handbrake only to find no brake activation.

im curious as to how he done this and hit a pole which sent him the other way into an oncomming car as per the op's post,
if this happened on the n32.

and yes, the guards will most definitely contact the owner.
least of all as the car will not be in the drive when he lands home and he'll be told where to find whats left of it

To be perfectly honest I think most of your 80 odd posts are a wind up, we had the "was my Corsa I've had for 7 years value" thread, then the "I'm buying a diesel for €20,000 ish" followed by "I've bought a 1.8 turbo A5" (which is still for sale actually according to the garages site) and the "my folks are spending €35K on an estate" and now this gem.

'tis all a bit looney really :)

To the OP and I don't mean to be rude, why do you care what happens, it's not your car you are not involved. To the guy driving I say shut up say nothing. To the kids I say your in deep s&it from daddy. To daddy I say send your daughter to a convent, and finally I say to mammy you of course were always right he should have bought a nice boring Volvo.

There's no potholes on the N32, certanly none of which could turn a two tonne? S Class on its side.

I've driven the the W221 S-class and you absolutely cannot do what the OP has described. Apart from the fact that its a parking brake and not a handbrake, you cannot activate it do perform a handbrake turn.

So he just lost control of the car more than likely. Sounds like a right twat, i'd be iffy about even sitting in someone else's car having a look without their permission, let alone starting it up and tearing down a national road. Deserves everything he gets.
