Right to request copy of will

    Just a quick one.

    I've been named as a beneficiary on a will. Am I entitled to obtain a copy of the will from the solicitor ?

    How do you know that you were named as a beneficiary? Were you told what your benefit was and did you get your benefit? If so, why do you want to see what others got?

    I got a letter from the solicitor stating I was a beneficiary and the amount I am to inherit. Nothing more.

    I got a letter from the solicitor stating I was a beneficiary and the amount I am to inherit. Nothing more.

    I'd suggest requesting a copy of the will. If they don't want you to know how much the others got, they can redact the will by blacking out the relevant sections so that only your gifts are shown. You are not entitled to a full copy of the will to see what everyone got.

    However, once the will is admitted to probate, it is a publicly available document.

    It is most likely the will has been admitted to probate. The solicitor would be foolish to write and tell you how much you are getting beforehand. The estate might be insolvent and it might not be possible to pay legacies.

    You could ask your solicitor to apply for a copy for you, might make it a little more costly but definitely easier!

    Sometimes it is essestial to write to beneficaries at an early stage as they may be required to give some personal details such as PPS Numbers before probate can be applied for.
