Extremely weird email from CeX dublin about my phone insurance claim :S

    Need some advice over this what do i do ?? .. long story short got insurance for my iphone 4 with cpp phonesafe insurance through meteor.

    I lost it on the 1st of August. Made a claim forms documents sorted no problems there.. And now like 5 weeks later i got this email from CeX shop in town stating that i sold them the phone !!! Its a shop where they buy and sell electrical goods.

    I was thinking the place where i lost my phone was in and around my area so whoever found it could have known and could have possibly sold the phone onto them ?? Chances of that are slim but its possible i guess ?????

    I do have a membership for this place. But i DID NOT sell them this phone !!!! I dont even know how the person who sold it to the shop if they did knew that i had a membership with this shop.. or maybe they didnt and just chanced it i dont know ???

    Their basically saying that im a fraudster like

    Heres the email..


    I am writing to you from CeX, 11-12 Liffey Street Upper, Dublin 1.

    On August 4th you sold us a white iPhone 4, 32GB


    The IMEI of the handset is ........



    You received €357 for the phone.


    On August the 1st an insurance claim was made against that same handset with CPC Phonesafe.


    As you signed a declaration with us on August 4th, stating your ownership of the phone and desire to sell the phone to CeX, thereby relinquishing ownership, this insurance claim must be in error.


    We have tried to contact you several times over the last few days to discuss this matter but have been unable to reach you.


    Can you please reply to this email as soon as possible with a time and method by which we can contact you to discuss this in detail. You can also choose to return to the store.


    If we do not hear from you by 5pm on Friday September 9th 2011, we will have no option but to contact the Gardai and report a potential case of fraud regarding the insurance policy on this phone.


    I sincerely hope to hear from you soon so this situation can be resolved.

    Im absolutely outraged and appalled by this it doesnt it look like that ill be getting back a phone that cost 610 euro that i genuinely lost and had valid insurance for


    Do i just go into the shop and explain that it wasnt me who sold it to them ?? I cant see them believing me at all though considering i do have a membership with the shop

    Any advice would be appreciated thanks

    Go back to the shop. They say you signed a form, demand to see the signiture. Also they must have CCTV, demand to see this. Without these things how can they be certain it was you who sold them the phone. If they dont produce these then ring the gaurds yourself while in the store.

    Ring your insurance company immediately and inform them of this. Keep them in the loop as much as possible.

    Okay thanks.. just in a bit of shock here

    What if they dont show me the signature if they say its confidenatal or something or the cctv ?? And if they show me the signature and i tell them thats not my handwriting ??.. They dont have to legally if they dont want to i guess unless the gardai are involved ?
    Then what would i do next ?

    Report the phone stolen at the local Garda station. Tell them it was sold at that shop. Give them a copy of the email from the shop too.

    just remember.. innocent until proven guilty, not the other way round as can be the case. don't let them away with it

    That's not really how it works with insurance claims unfortunately.

    It wasnt stolen it was lost and a term in the conditions of the insurance is reporting a lost or stolen phone to the gardai anyways so they already know about it being lost

    But yeah mentioning this to them and showing them a copy of the email sounds sensible just in case it gets messy in that shop.. thanks !!

    When the person who found it decided not to return it he became a thief. The person who sold it is guilty of handling stolen property. The shop that bought it is in posession of stolen property. You won't be getting an insurance claim out of this. The most you will get now is your phone back as it has been located. Your insurance won't pay out and if they did they will probably seek to claim it back.
