    Hi,

    My used car came with a 6 month / 10k kms warranty. If something breaks after the mileage, do I have any statutory rights?

    I would think not. Depending on the circumstances the dealer may extend a gesture of good will and part cover the labour or parts. But that would depend on the dealer and what car, what year, what mileage, what broke?

    Is this a serious question? Are you outside the terms and conditions of the agreed and contracted warranty? Are you over the agreed mileage limit? If the answer is yes then what are you even asking this for?

    Air con broke. Mercedes E class.

    You were given a specific warranty which was reasonable, if It's out of warranty, you're not covered. The goods were fit for purpose, warranty is up.

    I'm being serious. Under the aforementioned act, goods sold must be of meechantable quality. An air con lasting 4 months is dodgy. Hence I'm asking if that act supersedes my warranty.

    The aircon lasted 4 months plus the age of the car when you bought it which isn't necessarily 'dodgy'.

    I believe it does but only to do with the condition of the car at the time of delivery, after that you would be covered by your warranty. If you have already driven over the 10k then you would not be covered. Many warranty only cover engine and gear box and may not cover air con.

    Have you contacted the dealer, what did they say?

    Is it? If the car were new i'd agree with you, but parts can reasonably be expected to fail on older cars. Do you know exactly what's wrong with it? An a/c specialist might be your best bet.

    depends on the car really if its a 6 month old one or a two yr old one you wouldnt expect the ac to fail. if its a 20 yr old car then yea, honestly need more info in relation to it

    Reason I'm asking is: let's say you bought a Playstation and shop said there is a one month warranty. Obviously law overrides this policy. If it breaks after the month you would expect action.

    So I was hoping used cars would be the same.

    Dealer says not covered.

    I agree the car is 3 years old. I was wondering though if that matters from a legal view point.

    I'd imagine failure of a non-essential part after four months wouldn't be covered under the sale of goods act, but that's really just a guess on my part. Being practical, though, this mightn't necessarily be that expensive to put right. I've used an a/c specialist called John Kenealy before, and found him knowledgable and keenly-priced. Maybe give him a call? He'll come to you.

    How old was the car when you bought it?

    The reason I'm asking is because if it was for example 8 years old and the a/c crapped out after 4 months then you don't really have a leg to stand on. As an earlier poster said, things start to break, that's in the nature of mechanical devices.

    You were given a warranty with stated limits, you have now exceed one of those limits (mileage) so the dealer is telling you that the warranty has expired.

    1. You knew the limits of the warranty when you bought the car, you accepted these terms and conditions.

    2. The car is secondhand, that means you are at risk of things like alternators, gearbox, starter motor, a/c etc. failing through wear and tear, that's the risk you take when you buy secondhand.
