Did you buy "sold as seen" or was there a guarantee?

    There's always a guarantee.

There was a gentlemans agreement as regards guarentee. Was written nowhere about sold as seen?

If you bought from a garage you have a guarantee...

Are they going to fix it?

They havent answered my calls and when I got through they turned off their phone. I eventually got them a few days after and they tryed to say it was a trade sale. I have been having problems with the car since day one. Not so much like breaking down but just engine management light. I only found out yesterday after bringing the car to a specialist that it needs to be decoked. Are they liable to pay for it?

No such thing from a dealer to a private individual.

Yes, threaten with legal action (a letter if you have to). Sound like scumbags to me.

Name & Shame them here, to avoid others getting into the same situation??? Or is that against the charter?

Yes? All I want is the car fixed. Ive spent 300 euro so far through various readings and stuff. All I want is the car to go right.

Why have you spent money? Why don't you physically go back into the garage?

Sorry, against the Charter to name and shame unless you can link to a reputable source.

I have. They supplied me with a MAF sensor which showed up on the Diagnostics as the problem. Then when I went back and told them that the car still wasnt running right they started avoiding my calls?

Well go back into them again! I wouldn't be afraid of them or anything, it's not like a private seller.

What Car is it? Year, mileage and how much did you pay?

Sorry to hear about your mother.

I'm afraid you're in somewhat of predicament atm the moment so, could you get a friend to travel up with the car?

Send a letter if all else fails.

Yes, yes you are. But don't have it on the long finger.

Don't wait two months to go back to them, you need to bring the car to them to fix it, how would you expect them to fix it otherwise? (I'm not being smart and I understand your current situation, but that's the way it is)

What is the minimum guarantee a garage has to give? Is it 3 months? If so, OP, dont keep putting it off. Are they a SIMI registered garage? Does the garage sell other cars also? (ie an actual dealer, as oppose to selling a customers car).

Yes they are Simi registered. And they do sell other cars. Also this car actually belonged to the owner of the garage.

Sounds like it might be an attempt by the dealer to sell the car outside of the normal business.

Well its receipt is from the sales person in the garage so im not worried about that end.

They probably know you live far away from them and hope you will give up due to the inconvenience of the distance. As was said before you need to strike while the iron is hot and not let weeks and weeks pass.

Keep hounding them, call every day and try and get to the garage when you can.

Ok guys update. Got someone in to mind my mother. Im going up there tommorrow? Was told that it will cost 2000 euro to get the car right. What do i do?

  • Closed Accounts Posts: 12,035 ✭✭✭✭-Chris-

If you've little time to be visiting them, put it all in a letter and keep a copy. Make it polite but firm, let them know this won't be going away.

At least then if this drags on for ages you'll have proof that you flagged the issues on a certain date and that the issues have been going since then.

Hmm Thought de-coking a engine was think of the past, an 80's thing
Would you not try a product in it ? For cleaning vavles n such,
Or it could just need a good drive,I mean foot to the floor in every gear up to 130mph, that will clean it up,

  • Closed Accounts Posts: 12,035 ✭✭✭✭-Chris-

If it's clogged up, a good drive won't clear it.

It's not that uncommon, particularly in diesel engines. EGRs are getting blocked left, right and centre. They'll often be cleaned out if the driver's experiencing drivability issues, but the fact is that, if the EGR is coked, then odds are so is the entire intake manifold.

It's made up of engine oil deposits more than carbon deposits. A fuel system/valve cleaner won't do any good on it. It needs to either be cleaned with chemistry, or if it's bad enough then it'll have to be manually cleaned (parts washer or power hose).

If it's properly coked up, you'll be eating fuel as well as having lights on the dash. It's important to get it properly cleaned or it'll keep getting worse.

    a) I'd be very surprised if that worked, unless the coking is very mild

    b) I don't think the OP needs to be researching ideas like this. The responsibility for fixing this lies with the selling dealer

How should I approach him? Ive spent money since ive bought the car!

Write the letter before you get there.

You're highly unlikely to get compensated for any money you've spent.

Insist politely but firmly that the car's been like this since you bought it. It needs to be fixed to a satisfactory level. You won't accept any alternative.
You can gently threaten to go to the SIMI/your solicitor, but only if he's obviously not budging (don't go to the SIMI, it's not worth your time).

It's all about being polite, but making him know that helping you is inevitable, that you're prepared to throw all the toys out the pram.
Tell him next time you come to the garage you'll be leaving it with him to repair and will refuse to take it back if it's fixed.

If he's still refusing, say you want to get an independent assessor involved. Say that if the assessor says the car's ok, you'll pay the bill, but if he says it's a problem with the car that obviously existed before you bought it, you'll expect him to pay for the assessor and the repairs (and a follow up assessment to verify that the work is done properly).

All the time, have the strongly worded letter in your pocket detailing as much as you can.
Give it to him and let him know that he'll be getting further correspondence detailing every phonecall and visit, and that you'll pass the issue to a solicitor if it keeps dragging on (this is the nuclear option imho).

The ports on the 320d get coked up with carbon this is sometimes a result of glow plugs not working properly and not burning off excess fuel in the engine. This along with egr and it being a diesel. A coked egine sometimes give similar symptoms to a faulty maf. To do a proper job of decoking the engine the head will be have to removed from the engine. Some of the inlet/exhaust valves may have wearing on them so worth checking not to expensive at about 18 euro each. Cant see how it will come to 2000 if its just to clean it out.
