    I was driving on a dual carriageway today that had been re-surfaced. There was lots of very large signs warning of loose chippings the whole way a long the road, and again lots of very large signs saying 'slow, 35kph'. The road in normally 80kph. Now the chippings were very loose, and fairly large. By just driving without any other cars around me there was lots of chippings flying up so i slowed right down. Then this ass flies up behind me, alongside me and cuts directly in front of me with very little space, going well over the 80kph, not just the 35kph. All of this causes LOADS of chippings to fly up and hit my windscreen and chipping it in multiple places. I flashed and beeped at him but he didn't even notice. Then 2 mins later I was right behind him in traffic. That speeding through the chippings really helped :rolleyes: Anyway I was able to get his reg, car make etc but is there anything I can actually do? I'm thinking there's not, but I hope someone can tell me different!

    Report it to the Gardaí and claim against the other cars insurance?

    Matter of proof. Prove he was doing over the speed limit or that it was him for that matter. If I got that claim, I'd defend it until the cows came home. And I don't have cows.

    True, but I can't see any other options open to the OP. And remember it's up to the ins co, rather than the driver of the other car, to decide whether to settle.

    True. But they have to justify their decision if Elderfield & co come knocking. Op, you could attempt to claim. The odds of a success are up there with me winning rear of the year however.

    Based on what? I'd say the OP would have a fairly decent case(after all, aren't a lot of insurance incidents based on one persons word vs another?), I know I'd ring up the local Garda station and make a report.

    Have you comprehensive insurance? If so check out the policy details. Most insurance companies let you replace a damaged windscreen for free. Did it myself last month. Checked my insurers website. There was a number for an approved windscreen company. Rang that company and the came to my home, replaced the windscreen and I just signed a form. I did not have to pay anything and it doesn't affect my no claims bonus.

    Based on professional experience. Also my opinion.

    An Insurance Claim is an allegation. Like any allegation you need to be able to substantiate it.

    The OP Cannot prove that the Third Party was driving over the speed limit or that it was him that did it. They can give their side of the story but there is no actual proof.

    If there was lets say a paint transfer or something then it would all be very easy to prove. But there isnt, it's a stone chip

    +1 to Unkel. Use your windscreen cover if you have it.

    It's generally a benefit and wont hit your NCB

    Most insurance claims are almost impossible to substantiate unless you can take pictures of the event happening, doesn't seem to stop most insurance claims being processed *shrug*

    Usually when a car has been made 33% shorter it's quite obvious that an incident has occured.

    Most Insurance claims are quite easily proved. I've come across claims like this before however and they never run.

    If you have experience, you have experience! I don't see how this is any different to parking damage, doors being swung into your car etc etc though.

    Thanks for all the replies. I know it's going to be impossible for me to prove, but I'm just so angry. I mean, he had to know what he was doing because the chippings would have been flying up and hitting his own car. It just p.isses me off that even though I have windscreen cover and can get it fixed for 'free' (not really free considering my insurance premium), I just don't want this inconsiderate fool to get away with it. I'm also pretty sure he lives near me too, and considering I have his car details, maybe I could let a sharp object, say a key, accidently fall against the side of his car, causing a very unfortunate scrape...:D:D:D Ah I wish I was that mean!
