Can I claim the dole?

    Hi all

    I am a New Zealander and my husband is Irish. Married 10 years and we lived in Ireland for 7 years together up until about 2 years ago. I have residency through him but never applied for a passport. I was in full time employment for 6 years in Dublin and the company I worked for went under so everybody was let go. I signed on for about 7 weeks and got the dole as I was told I was entitled having paid full PRSI etc over those 6 years.

    Anyway after 7 weeks my husband got an offer of a contract in South Africa and we left Ireland and we have been living there for the last 18 months. The contract runs out in 6 months though and we are keen to move back to Ireland. My question is when we arrive I will probably have to wait a while before I secure employment what with the job market being what it is. Given that, can I sign on when I get back or did I give up that right when I signed off? Sorry if this sounds muddled but I heard from somebody that I am not entitled as I have not worked in Ireland for nearly 2 years. But I always thought my contributions up to the date of termination of employment were what counted?

    You might be confusing two factors; the habitual residency conditions and qualifying for social welfare benefit.

    You should not have any problem meeting the Habitual Residency conditions as you have a substantial work history here, your main centre of interest was here and it will be again when you and your husband return here.

    The relevant tax year on which the Jobseekers Benefit (which is not means tested and which you were previously claiming for 7 weeks) would be based would be 2009. You can check here http://www.citizensinformation.ie/en/social_welfare/social_welfare_payments/unemployed_people/jobseekers_benefit.htmlwhere you would stand in relation to qualifying for that.

    If you have the chance, it might be good to come for a visit to Ireland before you make the move back to live here. No matter what you find, you will benefit from having had the chance to observe for yourself and have realistic expectations re jobs etc.

    As Balagan said, the revelant tax year they will look on will be 2009, if it where a case that you do not have the required 13 paid contibuitons in that revelant tax year the following years can be used to meet the condition, these are the two tax years before 2009.

    The only problem you may have is when your going form JB to JA that is of course if you dont get work by then. Then they will look at the 5 Factors for the HRC.

    Thanks for all the info. I was in employment up to May 2009 so I have enough contributions for that tax year. The only thing is it will be 2012 when we get back and I will try to sign on. Will taht cause a problem? I have no earnings in Ireland for 10/11. Also what is JB and JA?
