Dress didnt arrive in time...

    Without going into the full blown story - I bought a dress online for a friends wedding. I was asked when the item was needed for and I told them 13th.

    The short story is that the 13th has been and gone and no dress; I emailed them asking for a full refund as they had missed the deadline and I got a reply with a tracking number (which showed that it was in Hong Kong)

    A few more emails went over and back - each time me asking for a refund and them resending me the tracking number.

    So today I realise that tomorrow is Day 45 since paying for same dress and if I wait until after tomorrow I can't instigate a Paypal dispute - so I did it today.

    What do I do now if the dress arrives - can I just refuse to accept it and let it be sent back or will I have to accept it and then have to send it back at my expense?

    I'd be inclined to go with the first option but dont want that to impact on my getting a full refund.

    Any suggestions???

    Just reject it when it arrives.

    Where does the tracking number say it is now? You should escalate your dispute to a claim, since it's been 44 days since you ordered and still no dress, and you've already been in touch with the seller several times.

    That's what I thought too.

    Actually today I got a note from DHL to say that they had the item in Dublin and that there is duty owing on it - I think I'll just ring them and tell them that I'm not accepting it for them to return it.

    re Paypal - I instigated a dispute yesterday (as it was day 44) so they have a certain number of days to reply before it is escalated into a claim.

    You can escalate it to claim yourself. In fact, if you don't escalate it, the case will simply close. Don't let that happen, because you can't reopen it once it is closed.

    Escalate to claim now.

    When you bought it, did you know it was coming from China? If you thought the seller was EU based, then you would not have been expecting duty and VAT. If the seller gave the impression that they were in the EU, then that's another reason to expect a refund.
