HELP: Probation period leave notice

    Please can you offer me some insight....
    I am on a probation period of 6 months and have a new job. In my contract there is no mention if what my leave notice is during this period. However, the company can offer me only 1 week notice to leave.
    After this probation period expires, I have to offer one months notice.

    Where do I stand - as HR has not mentioned anything about the probationary leave period, only that of a month.

    Is there any legalities? Is there a website I can find this information on?

    Hi Catsa,

    Leave normally mirrors what the company would give you, so if they can give you a week you can give them a week as well.

    Working for a company between 13 weeks and 2 years, by law they have to give you at least one weeks notice if they would like to finish your contract.

    Thanks... That is what I thought, but HR is telling me differently. And since it does not state this in my contract, do I have a leg to stand on?

    Where can I find official information on this? Do you know?

    I far i am concerned, i have worked for many organisation in last 5 years.
    - Depend on the company (T&C and Contract type)
    - my experience would be in Mc donalds, KFC and other food courts atleast 1 months
    - Contract jobs like addeco,ibm cd packing require's 2 weeks notice.
    - Call centre(amazon, billizard, AOL broadband) in probation no notice required, after completion of the probation as per the above companies need to give 45days of notice.
    -Speak to senior employee. He/She might give you more information :cool:

    If it is not stated in the contract then you only have to give them the statutory minimum which is 1 week.

    unless it is specifically stated in the contract of employment you need only give them a weeks notice. also since you are still on probation i think you only need give them one week anyway. probation works both ways
