when a sale is or is not a sale

    Take this as a story for others to learn from, but also I am open to suggestions as to how this may be resolved.
    A car is sold by a dealer:rolleyes: on behalf of owner. When contacted the dealer admits he is having no joy selling and that price will have to be lowered. This goes on for a few months. It just so happens that the car is seen being driven by a friend of a friend and when confronted about getting car he informs me he paid 50% more than what dealer is trying to get. AND that he bought it months previous.
    Neither can get a log book (I aint that daft) but they have tried.
    Gardai are powerless. Solicitors are at logger heads and it looks like going nowhere since buyer? will not return car . Dealer has closed up shop, and is neither refunding the dosh to either party.
    Lesson to be learned; don't trust another to sell for you ?
    ...any suggestions?

    have you got the car insured?
    reporting the car stolen would be the obvious, but maybe non correct thing thing to do?

    I cant see how the dealer could have completed the sale without your signiture on the deal also. Surely you can take the car back.

    Do I understand that you have got nothing for the car currently?

    I'm confused by this bit.

    Are you saying that (for example) the person now driving it paid 6k (for example) and the dealer is saying to the registered owner that he'll only be able to sell it for 4k, thus pocketing the 2k himself ?

    This is your car unless there is further information that hasnt been revealed.
    I would be going back to the gardai and pursuing it as a stolen vehicle, failing that inform them that you intend to take it back.
    The danger is they may not need to get your log book but get the affedavit and declaration and then its to late for you.
    Id be organising a tow truck from the current drivers location.

    Did try to report it stolen , Gardai went to dealer and he says he had permission to sell. So they can't do anymore :< There was no permission given to sell

    Neither car nor money. Just a log book and nothing happening with solicitors

    better than that, the dealer is has pocketed the lot.:(

    Was that not what the car was doing at the dealers? Your friend had asked him to sell it?

    Gardai tell me they can do no more ( Frankly I was mega disappointed at this)
    Tow truck would not get access to lock up where car currently kept.
    An effort was made to get a duplicate but was blocked.
