Law on Copying Online Images

    A person has copied a series of online images created by myself which they are selling as prints online.

    I can prove the online images were created by me as they have marks/tears and I hold the original photos from which I created the online images.

    I have been advised that as I can prove the images originate from me, and were created by me, I have what is referred to as proprietal rights to the online image, and that I should be entitled to take legal action against this person.

    However before I see a solicitor I was wondering can anyone point me in the direction of the law on this, or know what the Irish Law is on this.

    SUMMARY - What is the legal position when someone copies images you created without your permission ?

    Please note that my quesions is specifically to do with the copying of my online images and offering them for resale as prints

    Any feedback greatly appreciated

    It sounds like a simple case of breach of copyright.

    It certainly does seem like a clear case of copyright breach. The Acts have been updated since significantly since 1963 so that the applicable law is the Copyright and Related Rights Acts 2000 - 2007.

    You should see a solicitor ASAP as you can seek to enforce your copyright against this individual and obtain an award of damages (which can require him to account for profits he has made on the foot of your photos as well as aggravated damages). It is vital that you seek professional advice in this.

    Did you create the original photos yourself, or were they taken by someone else and you just scanned them in?

    Economic rights
