Hi, any advice you can give on this would be much appreciated. A friend of mine works part time in a creche. She has contracted ring worm from one of the children in the creche and is off work for 2 days. Her employer says she will not be paid for these sick days - is this legal? Many thanks for any advice you can give.

I suppose it is hard to determine whether she actually got the ringworm FROM work or not.

The child with the ring worm has been allowed to stay at the creche as his parents work. This is also the second time this has happened.

do you have proof that there is a child at the creche with ring worm ?

your friend would have to prove within reaso that the ringworm was contracted while at work. this could be very difficult to show unless see can track when this infected child was there and how long it was until she herself got sick. for the sake of two days it may be more trouble than its work.

its a shame the creche is like that though as it is common enough for childcare workers to get sick as they have a high exposure rate to children. she should start looking else where if they are that stringent.

www.nera.ie might be of some help. Otherwise you could ask the social welfare would they pay the 2 sick days off (with a doctors note).

Seems strange to me that creche owners wouldn't have some sick pay arrangements in place considering the high likelihood of it in the child care business.
