Amazon marketplace

I have bought two electrical items from Amazon Marketplace. (I currently get them sent to a relative's house in the UK and they send them on)

One was a couple of years ago when we needed a new battery for a laptop urgently. We ordered from Amazon from a site showing a pic of a battery clearly marked with the laptop maker's name. The battery that came was obviously not a genuine one, but it was needed urgently so we did not argue. Anyway it was a good bit cheaper than a genuine one so it was a fair bet. The ad did say and show that it was genuine however.

A few days ago I ordered an MP3 player from Amazon. I ordered from the main page and it said it would come from izone. I checked out izone and they had a good rep percentage so I figured it would be ok.

When the player came it was in a plain box with no printed material. I started to query it with the maker to see if it could be genuine and noticed a very faint R on the back. Refurbished.

I contacted izone and they said that they buy NEW players in bulk from the manufacturers (their emphasis). So why the R? They also said that it is described as new condition.

I contend that there is a difference between 'New condition' and 'Condition - new'. And anyway that explanation contradicts their statement that they buy NEW players.

They also said that they explain on their site that it would arrive in plain packaging etc. I did not have to go onto their site as I ordered from the Amazon main page.

They ask do I want my money back.

I could ask for my money back, or just shrug my shoulders and keep the player, which will probably be ok, (I have not charged it yet), and if it is a dud I can then send it back.

My issue is that there is deliberate misleading going on here. If I wanted a refurbished item I would buy one, but the whole set up is deliberately made to be confusing. Do I pursue it with Amazon? Is it worth it? I buy a good bit of stuff from them, mostly books, and they are fine. Is Amazon shooting themselves in the foot by encouraging this kind of messing? Has anyone else pursued this kind of thing other than by just asking for a refund?

Evidently my problem is unusual! Probably because it is difficult to buy electronics from Amazon UK in Ireland.

However apparently the rule is: if you buy something described as Brand New you will get new, if it is described as 'new' or 'new condition' or 'condition - new' you will get either a refurbished one or a copy/generic version.

    Edit - situation sorted

Partly laziness, and partly I don't like giving out my card number to random sites -you are also still open to getting dud stuff and do not have the Amazon assurance that they will sort it. Though I have bought from other recommended sites occasionally.

That is why I am so annoyed at this incident as there is an element of trust with Amazon that they are reliable, and in most cases they are, there seems to be a breakdown with electronics though.
