Car Key Stolen from gym locker - Who's responsible?

    Someone I know had their car key taken from their gym locker (along with their phone). The robbers didn't take the car, they just looked inside the car. The key hasn't been found. Thus, the person had to get a new car key made and it cost several hundred euro.

    My question is...Does the gym have any responsibility in this situation and should the person be compensated by the gym? The person had his belongings in the gym locker, locked with a lock bought from the gym's reception. Is the gym liable?

    not a legal expert but my gym has signs up saying stuff left in locker's at owner's risk.

    Was there negligence on behalf of the Gym? i.e. was there an expectation that the lockers secure enough to be putting such valuables in them?

    Yeah I suppose that's the angle I would take..that I should expect to be able to leave my items in a locker and not to have them stolen.

    Has this happened to anyone else and what has the gym said or done?
