Who is liable for accident in house?

    I am renting a house and have a child. A neighbours child entered the house uninvited ( not uncommon), and went to run out to other children in back garden.

    Unfortunately the patio door was closed and the child ran straight into it.
    The glass broke and the child has minor cuts on their leg. The shock was probably worse.

    My question is simple. To fix the door costs 400 euros.

    Should this Childs parents pay or should the landlord pay?

    Or am I responsible both for the cost and any potential claim for hospital attendance and/or medicines?


    All comments welcome whether good or bad!

    Your question was on the legal aspect. I know nothing about the law.

    The repair bill for repairing the door.
    You could tell that child's parents: "the repair of the door that your child damaged cost me €400".
    Where: At best on neutral territory or ask them to your house. Also prepare in advance what you tell them with a person who will back you up.

    Liability for that child's hospital bills
    You should ask a professional solicitor. (The difference between a layman and a professional solicitor is similar to that of an amateur first aid man and a hard nosed professional surgeon)

    Not seeking legal advice ..I,m just asking general dealing with people suggestions. I don,t want to anger parents or landlord that might instigate something bigger.

    Would a regular parent think I was unreasonably asking for the cost of the door or like years ago...tell the child to watch where there going and simply pay the bill.

    Reverse the roles, if the accident happened to your child and another parent asked you to pay for the cost of repair what would your reaction be?

    Personally I'd speak to the Landlord first to see if their insurance will cover it.

    Yikes, this is a tough one!

    So if the child was one of mine............well, you did let them in the front door somehow (you wouldn't let a stranger in!!)..........ugh.........emmmmm........I'd probably agree to split the cost. It wouldn't bother me being asked at all. I'd say halves if the best you would get (insurance aside). I'd say most people would not pay anything. Good the child is ok.
