Casual jobseekers benefit and problematic employer .

    Basically my gf is employed on a flexitime contract in a retail store.
    When she first took the job in late 2010 she was getting 20+ hours a week spread over 5 days . However recently hours are cut back to usually 15 and sometimes less over 3 days .

    She has asked her employer about going on the casual benefit and the employers repsonse was they fill in a form over 13 weeks with the accumulated hours ???

    Surely this is an entirely bogus reply and the the employer would sign off on the hours weekly , as in some weeks she would be entitled to it other weeks probably not .

    Any suggestions on this the employer is being uncooperative but we have no problem forcing the issue if i have hard facts that she would be entitled

    There is a form that requires 13 weeks of wages to be filled in your GF will get this form when she applies for casual benefit,it is the last 13 weeks that the info is required for not the next.

    what about them point blank refusing to fill out the casual labour form though, this is a large retail store and apparently they have refused to fill it in for other staff too?

    hi Outkast... i have heard of this happening with a major grocery/retail store... they refuse to fill out forms. Unfortunately if this is the case there is nothing that SW can do. The best thing that can be done is to get onto union as to the best of my knowledge if this is the same store that I know of it is unionised.

    I think that a formal complaint to the dept of family affairs might be the way to go,also contact the revenue commissioners in case the employer is not up to date with their payments.

    The employer would be up to date with payments its a National grocery and retail store. Its unusual for such a large scale employer to be so unwilling to fill out a form .
