Speeding fine received but not him driving

    By brother who lives in northern Ireland sold his car to a guy in co meath on the 12th june last and give the guy the logbook as he needed it to vrt the car but kept the export part to send back to the Dvlni..

    Anyway he has now received a speeding fine+ points later i suppose from the police (PSNI) which stated the date of 12th June .
    This is the very day he sold it and was not him…
    Was caught by speed camera gun doing 43mph in 30mph zone from unmarked car in newry which does be in that area regularly…

    How do you prove it was not you as happened on the very same day that he had the car and dvlni in coleraine would not have got the export cert until few days later..

    Do these unmarked police cars with their speed camera take a photo of the person driving or just the reg number of the vehicle…

    he hoping it wouldnt come to the court stage
    well he has no proof of sale and since he was based in co.meath he would need the logbook to vrt the vehicle so no need to fill in new owners details on l/book unless he was living in the UK as they couldnt send him a new logbook anyway.

    are they able to get pictures of the driver with these cameras?

    All he needs to do is nominate the purchaser as the driver of the car, and the DVLNI will reissue the ticket to them.

    ok so he contacts the dvlni direct regarding this fine and person he sold it too.. and not the psni ??
    he has already sent the export certificate to the dvlni saying the car was exported on this date so car no longer in the uk..

    He doesn't need to contact the new owner of the car at all. It's like this: The registered owner of the car has received a speeding ticket, but they were not driving. They nominate the driver of the car to the authority who issued the ticket and, once this has been accepted, their liability is at an end.

    ok was a psni ticket,but dvlni would have the details so maybe best to contact them too..
    the new buyer wrote his full name and his address as moynalty. co meath -bit vague the address( may not even be correct details he gave him) on a piece paper but to date the car has not been duty paid ..

    if the psni can get photo from the camera it would clear it up it was not him but maybe these only take the reg number of the vehicle

    I can't really see a way he can claim it was the purchaser driving, as OP's brother after selling a car has no clue what was happening with it.
    It could be purchaser, or it could be someone completely else, in which case claiming it was purchaser driving would be a false declaration.

    What OP's brother should have done, was to write a contract of sale during transaction, which would include buyer and seller details, car details, date, time. Made in 2 copies (one for each party) and signed by both of them.

    Then he would have a written document, which would prove that at the time of offence, he was not the owner of the car anymore, which would clear him from any responsibility.

    Yes Ive always done this. Both sign it and if they drive away without insurance and have an accident or get tickets etc, its not my problem.
