US Warranty on Item bought in Europe

    Item for sale from International seller, is going to ship from uk. Its not for sale in Europe and has a 1 year Warranty in the US.
    The seller is saying they only guarantee it for week and then its manufacturers warranty and I would incur any costs to get it back to the manufacturer in the US.
    Its not a private sale, therefore is this not a breach of my consumer rights under EU Law?

    If you buy from an auction site (eg: eBay) then as far as I know, consumer rights under EU Law don't cover auctions as you are buying from a private seller and not a business.

    I could be wrong though, I'll have a look for some info and post it here.
