Advice needed about a dispute I'm having with a clothes shop

    I bought a new jacket last week and within half an hour of wearing it, the zip broke. I brought it back to the shop and they told me they'd give me another jacket but they then told me that they didn't have any of those particular jackets left. They offered me a credit note but I wanted my money back. They brought my attention to a sign in the shop which said that they did not give cash refunds, and credit notes would only be issued.
    I was under the impression that if I purchased a product and that product was faulty or didn't work, then by law, I would be enititled to get my money back. I told them this but they are still refusing to give me my money back.
    I'm wondering if somebody could give me some advice here. Am I entitled to get my money back? Have my statutory rights been infinged because of their refusal to give me a refund but only a credit note?

    I'd be very grateful if somebody could answer this for me.

    Under the Sale of Goods and Supply of Services Act 1980, anything you buy from a retailer must be:

    of merchantable quality
    fit for its normal purpose, and reasonably durable
    as described, whether the description is part of the advertising or wrapping, on a label, or something said by the salesperson.
    When you buy goods from a retailer, you make a contract with him. He agrees to provide certain goods to you for a certain price. If your purchase turns out to be faulty, the retailer, not the manufacturer, is responsible to you and must sort out your complaint. You are entitled to a refund, a replacement or a repair.

    You do not have to take a credit note if your complaint is covered by the Sale of Goods Act. You can insist on a refund, a replacement or a repair.

    Yes you are entitled to your money back as it is a manufacturer fault not simply that you change your mind ,If you look up Citizens Information you should find all the laws there to do with this. You should print this off and bring it back to the store in question,

    Take another visit to the store, bring with you a printed copy of your consumer rights and make sure you fully understand them. Ask to speak to the manager of the store and confront them with the printed copy and your knowledge. Insist on a refund immediately. If they refuse tell them you'll have no choice but to take the matter to Small Claims Court as you are covered by The Sale Of Goods Act.

    I have had a number of successful complaints processed by The Small Claims court but in my opinion most stores will be happy to refund you exactly what you paid once you confront the manager with your knowledge of your rights ;).     I'm unsure the signs are illegal they just do not hold up against faulty goods.

    any sign which infers you do not have all sogsos rights is illegal It has to carry this does not affect your statutory rights and these include right to refund http://www.castlebarcu.ie/images/library/documents/uplimage_11-04-2011-112009.pdf
