change of ownership dispute

    So i sold my car in february and gave the log book to the dealer in ignorance.
    Surprise surprise i just got a toll fine in the post. I have contacted e-flow and they have put the fine on hold until they get the new owner details from shannon.

    i rang the dealer and he is trying to fob me off saying the book was sent to shannon "ages" ago when he sold the car on. Shannon tell me they never recieved the book.

    What should i do apart from kick myself for not reading the change of ownership protocol properly! the dealer is registered and owns a car dismantler business also.

    Even if the op hasn't got an eflow account, they will receive the toll bills as the car is in their name.

    Couple of strange things:
    1) the garage didn't complete an rf105 to transfer the car from the op to the garage

    2) the new owner never looked for ownership papers in the meantime

    These certs don't just get lost in the post.

    To be fair,you should of transferred your eflow account when you bought a new car,thats what I do.

    I dont have an account though. Would have transferred if i did!
    My main fear is this shannon wont take my name off the vehicle registration and the dealer is claiming he sent it off with new owners name which i have reason to believe he didnt do. How long is it taking for shannon to process change of ownership anyway?

    Your dealer should have been able to transfer your ownership online.

    It's not transferred.

    If I were you I'd turn up on his premises and make him change it online while you stand there, and print off the confirmation screen.
    He'll need the VLC number, so you'll have to verify he has a copy of it.
    Also make sure the date of sale is the correct one - the day you collected the car.

    This isn't realistically gonna happen. If the dealer mislaid the cert, he's not likely to have photocopied it, or even have a filing system in place for certs.
    I also doubt he's registered for online changes of ownership. Not many small or indie garages are.

    Quickest thing to do is do an rf134 get the replacement cert, get the new owner to sign it and backdate it.

    From dealing with eflow before, I'm surprised they're this accommodating.

    You might be waiting a while for the garage to sort this out.

    True. I know we photocopied all certs, but probably not everyone does.
    I presumed all dealers could change ownership online, you learn something new every day! :D

    I know we used to copy completed all vlcs and file them by reg. We used to keep copies of rf134s and rf105s too. A lot of garages don't though, and a lot of garages aren't online.
    Even with all our being careful, when we went online with our paperwork, we saw a list of cars in our name, some going back 10 years. Rf105s that weren't ever changed into new owners name.

    Just yesterday got a letter of eFlow for a car sold to dealer. Updated eFlow account info with Customer Service on the day. But still - the fine came by post to the last known address.
    Called them and explained the situation. Luckily the car was already put in dealers name - https://www.motortax.ie/PSE/start.do?page=welcome - she said I can bin the letter now.

    But I am still waiting for a logbook of a car I bought of a dealer the same day.
    I do have a copy but it's useless - can't pay road tax, can't pay parking permit.

    I can see the old banger is in dealers name but no notion under new to us car reg. Is it really that hard to process two documents the same day?

    After all those years of reading stories about logbook never sent or car bought without a logbook, I still don't get it.

    Why on earth would you buy a car without documentation or even selling yours without having the buyer signing it on the rear and sending it yourself in registered post while the buyer is present.

    Just get real people

    What documentation would you suggest the buyer should have asked for?

    Fill in an rf 134 get it stamped in your local garda station go to your local tax office pay the € 12 ( or you can do by post ) When the replacement licencing cert arrives in your letter box fill in the new owners name and address and send to Shannon ! That way you know its done !!
