My car is a write off, or is it?

    I was recently involved in a motor accident, I won't go into specifics as it's an ongoing thing but suffice to say I'll be keeping my no claims ;)

    I got a quote from an independent garage, all above board stuff. Gave the quote to the insurance company, they are saying that my car has depreciated 33% over the course of one year from 3,000 to 2,000. Now the repairs are slightly over the quote I got and they want to assess themselves. One thing is for certain, 2 grand will never replace the car itself, not by a long stretch has anybody had any experience of this? do I have any rights?

    If we car's a write-off they legally have to give me enough money to find as similar as car as possible, such cars are selling for 2500 at the moment...

    If the car is genuinely worth more than they are offering refuse to settle. One well known insurance co (they are currently in administation) tried the same tactic with me a few years ago and re evaluated the value of the car there and then. They increased their offer to what the car was worth 500euro more than what the were originally offering.

    You have the right to negotiate a price. If it is the company nogoodnamesleft alludes to then they are always very eager to settle quickly. Of course they could just say no at which time you will have to take the legal route but if your offer is reasonable they probably would just accept it or try to go half way. So demand €3k if you are happy to go say €2.6k or something like that but don't be a push over as they will gladly push you over.

    Thanks for the advice, I don't really need the Car fixed ASAP so I can wait them out for a while, that being said, they have been remarkably helpful up to this point.

    This wouldn't be a problem if they still had to replace the car rather than write me an cheque :mad:


    Their assessor is taking a look tomorrow so fingers crossed.

    It doesn't seem like they are that far off really and excluding a few variables such as mileage, condition and spec level, 2k could be bang on what its worth.

    Don't forget they work from book value not market value

    I assume if it wasn't your fault that you have gotten the other party's insurance company to pay for a rental car in the meantime?

    Funny enough I was speaking with my father about this very thing only the other day. He had a car written off, and the insurance crowd came back with an offer that was way under what the car was worth. His car had a few extra's in it and the insurance were offering him book value for a lower spec car. It was left to him to prove that he couldn't buy the same model car(including the extras) for the money he was being offered. Eventually they came back with a higher offer, but still lower than what it was worth.

    They'll usually offer lower. Some are not too bad though, when I worked in Galway I shared a house with an insurance assessor. He used to use Carzone etc for an average and knock a few percent off that.

    People are asking I guess, I've found a few same year cars with ~35-40,000 more miles selling for 2750.

    It's still roadworthy, just. We're with the same insurance company.

    If the book value is unattainable then surely its worth is regulated by the market, then again that would make sense and be fair to the wronged party, which in Irish law, aint gonna happen :(

    Put up a detailed description of your car including make, model, year, mileage, service history etc and someone may give you its book value or a goood idea of what it is worth

    But it'd be very difficult to get one for 2K, I know I'm going around in circles a bit but I don't understand how the car can be worth less than it's price if you get my meaning. It's very difficult to replace the car I've lost for that much, which is in my insurance contract.

    The car is immaculate btw with new-ish tyres if that makes any difference.

    think 2k is potentially a good price...

    quick look at donedeal, searched yaris 2001....
    first four price range from 2100 to 2500..... and thats just the asking price... so getting an yaris for 2k seems to be easy....

    A private seller advertising at €2500 would be very slow to reject €2000 cash. That's my opinion anyway.

    Got on grand, assesor said to me that the quote seemed accurate and the condition of the car was such that the Insurance should agree to have them carried out, hear back from them tomorrow.


    I think we may have a result :)

    Just an update (don't what to be an op that asks a q then leaves!)


    Car is a write off, unquestionably. Not resolved yet as a claim but the damage is more than first thought.


    Obviously I can't go into specifics but thanks for the advice.

    Personally id never drive a car that has been nearly written off, i had a bad accident a few years back and Quinn wanted to fix it, i told them hell no.

    Makes no difference. My friend sold his 04 yaris for 3,300 there last week that was a good price.

    There is an option of buying your car as scrap after and you could use all the parts then? Usually can get a good price after a settlement.

    Quick question.
    Last Wednesday I has rear ended by a big coach and the car(Honda Civic 01 85k miles) is a write off. Cars of similar mileage on autotrader go for between 2500 and 3000 euros. I have the assessor coming out on Monday and after checking on the vrt calculator the open market sales price is only 2000 euro.
    My question is do I have any say or argument with the assessor if he offers me below what I am looking for it.
    I am not looking for anything extra just the fair price for the car but I don't think I should come out financially worse especially when I did not cause the crash in the first place.
    Any advice would be greatly appreciated.
