Insurance claim - Please help!

    I had a minor accident on Monday. I was turning right at a junction in an estate. After completing about 90% of the turn and proceeding in the correct direction.. unfortunately a car came suddenly from the right toward my car and crashed into the side of my car. The other car was driving on the wrong side of the road (right hand side of the road) rather than driving correctly (left side of the road). It is clearly the other persons fault but he is not taking the liability for this accident. We both contacted respective insurance companies. But my insurance company told me that I can take option of contacting the other person's insurance company directly and process claim from them as this case is very clear that the fault is with other person.

    My question is - how much time will it take for the insurance company to find out whose fault it was? As that person was not taking the liability, I took pictures of the incident, which clearly show its his fault. Will I need to send those pictures to other person's insurance company and when? What is the next step for me?

    Ask your insurance company how to proceed.

    Internet folk aren't really going to be able to help you with this.

    Assuming you have his insurance policy details, contact his insurance company and claim for any damage. Send them pictures as well.

    The problem here is that it's generally your word against his. Pictures might help, but that's nothing sure.

    this happened to a friend of mine last year.. except he was going down a main road and a car pulling on to the road hit him.. obviously e was not in the wrong.. both cars were as good as wrote off.. it was an elderly man that pulled out in front of him and said he was speeding..

    the man wouldnt admit he was in the wrong.. until my friend set a court case date.. the the man admitted this and e paid for the car to be fixed..

    this tooke about 6 months in total... if theres not much damage your better off jus to ask the person for some cash.. or pay for repairs your self..

    insurance is a joke.. they jus rob you..

    if theres alot of damage done then your better off just to take all the time it needs to sort this properly

    Don't do this unless the other person gives you the cash to do it. Friend of mine had a minor crash. other persons fault. They admitted it and said they would put it right and told him to go get it fixed. He got it fixed and then they refused to stump up the cash. Down about 700 quid. costly lesson in dishonesty

    If it's the other guys fault then it's your responsibility to pursue it, your insurance company is not there to fight battles on your behalf, that's what you pay solicitors for.

    Fair enough if you want to claim it off your own comprehensive insurance but that comes with the risk that you lose your NCB and the OP hasn't mentioned that he has fully comp.

    Send the other guy's insurance company the photos and your version of what happened. If your insurance company think it's the other guy's fault then his own insurance company will probably come to the same view and pay out.

    You pay for insurance to cover the damage that you do to other people, if someone hits you then it's your problem so don't expect your insurance company to sort it out.

    I had 2 incidents over the years and in both cases the other person was at fault. I contacted my insurers and they handled everything. My car was repaired by the dealer I bought from and cost me nothing. And, no impact on my NCB. That's what you pay insurance for!

    Yes. I did but they said they cant come because there is no injury.

    I contacted other persons insurance company and their agent visited me to see my car and accident spot. As per him, this is a clear case, its other persons fault. I have taken over 25 photos of the accident with different angles and all shows the other person is at fault.

    But unfortunately insurance company did not want to go that easy.. probably insurance company is still supporting their client because they dont want to spend money although its obvious the fault is with their client. They are tring to create problems so that they can delay the case and so the payment of claim amount.

    They are sending another person to again inspect the site and my car.. If they send 100 people to check this out again and again, they will get the same results but the insurance company is adamant to prove their point in favor of their client so that they can avoid payment and trying to save their client who was driving carelessly and speeding within the estate where children are playing and speeding is not allowed...

    can anyone recommend a solicitor (probably no win no fees basis) ? If a solicitor sees this case he will be surely interested....
