Garden wall damaged bordering public park.

    Afternoon all,

    My back garden wall backs on to a public park and over the years the foundation has subsided causing the wall to become severly cracked.
    It has gotten to the stage that I consider it unsafe to both my family in the garden and the public in the park.

    I am getting prices to have it knocked and rebuilt.

    This will involve having some machinary working on the parks land.

    Do I need to notify the county council or parks dept to get the ok for this work?

    How is this type of work normally handled?

    I am assuming I dont need PP as the new wall will be identical to the old.

    I'd assume that your estate has at this stage been taken in charge by the council?? You may not actually own the boundary wall so, if the council have taken in charge, contact them.
    If they deem it unsafe, they may even do the work themselves;). It could be argued that it is a serious health & safety issue. They wont necessarily care if the wall falls in on you but if it fell the other way and injured someone, and it's under their remit, they could be open to a claim so, on this basis, they may actually do the work.

    You should be aware that if you have to do it, you will have to leave good the park area in state as found, and they may insist all insurances are in place before they will allow works on their lands.

    It's never simple in this world:D
