drivers wing mirror brken in carwash

    hello, i new here and am looking for help/ ideas on who should pay to fix my

    wing mirror.i went to local electronic car wash on Sunday 1/5/11 at 6pm, for a
    car wash. the mirrors are electronic and were in. the brush rolled over the

    drivers mirror and i heard a crack. when it was finished i moved my mirror

    would not open out , so i knew it was broken. the hinge seems to be gone

    that moves it in and out. I left details with garage to contact me ,nothing, so

    on Tuesday went in and showed manager damage. she phoned car wash

    company to come down from Dublin and look at the cameras . they came

    down on Friday 6 th may , looked at the camera, saw i had my mirrors in, but

    there saying it couldn't have been done by car wash. the company is called

    "wash craft". The manager said i can leave a letter in to the garage , but its
    up to "wash craft" to pay for any damage., and there not accepting liability.

    has anyone ever been in this situation, and throw any light on what i should do? thanks for reading this and for any replies that would help .

    The garage is liable for any damage,not the supplier of the equipment.You're being fobbed off.Get a quote to fix the damage and present it to the manager of the garage.

    I don't think your in luck. These place usually have a disclaimer saying any damaged caused is not covered, use of the machine is at owners risk etc.. Check for signs.

    The only time I heard of a garage paying was when they knocked the aerial off my car when it was been cleaned by staff at the jet wash. The flute smakced the aerial with the brush and broke it, just as I was getting it cleaned to hand to a new owner.

    These disclaimers would rarely be worth anything. The machine is expected to clean your vehicle without doing any damage to it, so it would be impossible to put up a disclaimer saying that the company are not liable for any damages that occur to your vehicle.

    Some places have a specific warning up about removing/retracting your aerial. This is valid because you are being warned about a specific known problem.

    But if the machine inadvertantly crushed your car into a cube, they couldn't turn around and say, "Tough ****, you saw the disclaimer".

    That said, in the OP's case you could be out of luck. Given that your mirrors were retracted, the video is unlikely to show the damage happening.
    There would also be a reasonable argument from their point-of-view that since your other mirror didn't break and other customers' mirrors haven't broken under the same conditions, then this damage is down to a material fault in the mirror rather than any mechanical fault or negligence on the part of the machine operator.
    That is, that part of the mechanism or the hinge was inherently weak, which wouldn't be the garage's problem.

    How old is the car? Could you make a claim under the manufacturer's warranty?
