    Here's a question. My partner is in receipt of jobseekers allowance since march 2011. He had registered and signed for himself. Im in afulltime job and recently i was fell out sick from work and put in a claim for the week i was out of work. Today i received a letter stating that i cannot receive payment of sick cert because apparently he is receiving money for me thru his allownace. I dont understand this and what is the possible outcome?

    Possible outcome court case ect.Your OH appears to be in receipt of excess social welfare payments.you must get the dept to check and if necessary adjust his payment.

    When one member of a couple is claiming JSA and the other is working, the means test is generally done as

    single rate + adult dep rate - means from adult deps earnings.
    For an example:

    188 + 124.8 - 300 = 12.80

    So if they have €300 means, they received €12.80 JSA.

    So you see, you ARE a dependant on your partners claim.

    What you do next is.... on the notification from Illness Benefit it should ask, do you wish to remain on your partners claim or claim in your own right.

    You should claim in your own right if you have enough contribuations paid to claim Illness Benefit, if you don't..... stay as a dependant but the means should be removed.
