Sony Ericsson Vivaz Charger Problem/Broken

    My son bought a Sony Ericsson Vivaz mobile phone and had it less than two months when there was a problem with the phone charging. Took it back to the shop who sent it for repairs. The phone was sent back as damaged due to being dropped (it wasn't). The shop wont refund as they say they follow what the repairer says. Sony wont refund as they say the contract was with the shop. I have googled this and found it to be a common problem, it is even on Sonys own website forum! Has anyone else had a similar problem? This phone cost €250 he had been saving up for it:mad:

    You can waste your time all you like with the shop and sony, but you will probably get nowhere. The phone companies are famous for their unreasonable policies so you might as well just go straight to the small claims court.

    Try once more with the shops head office, attaching the details from the sony forum. Your contract is with the shop, not Sony, and if you still get the run around, small claims it is.

    Make sure you register your letter to the shop. It will help with the court.

    I have actually gone through the small claims court on my sons behalf. I feel it should be Sony not the shop that should pay as it is a common problem with this phone but my contract is with the shop as they are who received the money. The shop cant do anything as the 'Sony repair centre' said it was not under warranty as 'user damage' even though the user did not damage it - a bit of the charger came off. I agree with you phone companies need to take more responsibility for the shoddy workmanship of some of their products and their appalling customer service. Surprised they didn't use the old chestnut 'moisture damage'.

    The Sony warrenty is only valid when you are making a claim with Sony but as a consumer you have statutory rights which superceed any Sony or shop warrenty. If you can show this is a common issue with the particular phone then you have a good case with the small claims court even after Sony have claimed it is customer damaged.

    is it possible though that it was dropped or damaged without that being known to you?

    did you ask for proof of this from them also?

    :DWent through the small claims process but when the shop received notification from the courts they contacted Sony who as a gesture of goodwill offered to replace the phone with the same one again or their Sony Ericcson X10 Experia (€450) Son chose the Experia (obviously) So have a happy chappy and happy me.
