late fixed penalty

    I was clocked speeding on the N7 in the wifes car on 17/02/11, 115 in a 100 zone, i've no issue paying the fine and taking the points but the ticket only arrived today but has a date of 01/03/11 on the fixed penalty. Called the number to be told i have 10 says to pay 120EUR and the points are already on the wifes licence (she wasnt driving) Is there anything i can do bar going to court?

    If it was issued by a Garda you can write to the local superintendent and ask for the ticket be reissued in your name. Or you could contact the Garda who issued it and do the same.

    If it was a GoSafe one then I think they have their own process for appeals.

    you criminal 15 klm over the limit
    why thats nearly warp speed

    thank god we have such an effective law enforcement
    prepared to hide on a dangerous motorway to catch these people
    this kind of criminality must be stamped out....
    let the wife kop for this one

    You always get points for a speeding offence. If you pay the fine you get two, if you don't and are convicted in court you get four.

    You seem to be under the wrong impression that paying the fixed fine means no points.

    Incorrect.

    Just pay it - you'll/the wife will get four in court.

    Where did I say that? The issue is with me receiving the ticket one month late and therefore not being able to take the points. Read it again.

    He never complained about the points? He's complaining that he hadn't received the notice in enough time to make sure the points applied to his license and not his wife's.

    From what he posted in the Motors forum he has said that since the 28 days have expired he can't take the points himself as he has missed the opportunity do do it. So choice is to pay the fine and have someone innocent take the points or not pay the fine and hope the judge will accept why he went to court and risk double the points to get them on his license as he is the one responsible

    I'm going to court with this. Spoke to the local sorting office and they are making a statement saying they believe the letter was delivered to a similar address in the area (has happend a few times previous). How do think a judge will look on this case? I am willing to pay the original 80 fine and take the points.
