breaking the lease

    just wondering if there is a condition in your contract that if you terminate the lease early you will forfeit your deposit does this take preference to statute which provides that you may break the lease if you given the appropriate notice and offer to sublet the property. if the landlord refuses to sublet the property you are entitled to terminate with your full deposit repaid?
    would be grateful if anyone could let me know please.

    You should be able to get a deposit back if, you can get someone to continue the lease on for you.
    as long as you give 28 days notice (in writing) and find a suitable replacement to the rented accommodation to continue the lease there should be no problems.
    your deposit would then come from the person/people who move in as the landlord will retain the deposit pertaining to the lease.

    subletting the property would not be a wise move, because you would be responsible for anything that goes wrong i.e damages, unpaid bills etc etc during the period of the sublet.

    On a general point some statutory provisions can be contracted out of, others can't- this might to mentioned in the act. If in doubt go to a solicitor.
