Mute Button on 3gs not working

The mute button on the side of the phone has stopped working. Has this happened to anyone? I got the phone in carphone warehouse last september so I would assume that its still under some sort of guarantee but i'd rather be able to sort it myself. Any ideas?

same happened to me, call apple, they will take it back and send you a replacement.
